Hi, i have received my second reply from Natwest.
I have followed the templates and sent letters requesting my charges back at the time were only £540 spread between my current plus account and my business account but since then i have recovered more statements and this total has since escalated to £1237.
They have both times sent refusal letters back basically saying they think their charges are fair and by no way breaking any laws and saying the "OFT didn't extend to include business banking facilities".

I would appreciate it if anyone could let me know if this is correct and to wipe these out of the case before i take court action and try to claim the charges for my current account or wether to just go ahead and put a claim in for both?

Don't worry. They are trying to put you off.
Have a look over at the forums on https://www.consumeractiongroup.co.uk they have more comprehensive section on claiming from business accounts. You can claim these charges, but sometimes there are slight differences in procedure. Hmmm .. I had an interesting letter from the Court today.
In regard to me bringing to the attention of the judge, Nat West asking me for details under CPR 18 Part 2; this is what the Courts have written back ..
<< Your letter dated 25 January 2007 has been placed before the District Judge who directs that he does not wish to comment >>

LOL.........The judge doesn't want to commit himself to anything. This isn't good or bad. Your letter is at least registered with your claim. If needs be, you can refer back to this at the hearing (unlikely you'll get that far). This response is nothing to worry about.
The worst thing that could of happened is that the judge could have asked for you to complete CPR 18. Although CPR 18 doesn't apply in small claims cases, under CPR 27.3, a judge can order for this to be completed. In your case this hasn't happened.

I probably wont risk re-claiming my charges then. I could never pay off the overdrafts if they closed it and I'd be in worse financial doo doo than I am now. I don't think my credit rating is good enough now for another bank to transfer my od's.

susplum, I would certainly make a start in asking for your info/statements and once you have worked out how much you will be able to reclaim you can then think about which way you want to go.0

Hi,
Natwest have filed a defence, and we have submitted the AQ form.
Attatched to NW's defence is a request for further info and clarification.
Does anyone know what the next step for this is. It says that if I don't reply by the 5th Feb thay can request that the courts strike out the claim.
A list of charges that I am claiming was sent to the bank with the first 2 letters, but not to the courts.
Can anybody advise what the correct course is.
