    A lot of banks are doing this. Do not let them dictate their own schedule to you. As soon as your deadline is up, move to the next stage.

  • Like loansouluk, I too have received my "we are considering your claim" letter off Higley. In fact, I received that yesterday. It will be 14 days on Monday since my original letter requesting the money.
    Should I send my "since I have not received a satisfactory response" letter immediately, on monday/tuesday when the 14 days have passed or do I wait until the contact me further?

    They received the claim forms from the court on Thursday past and what do they do!!!!! Issue me a default and another £30 fee and the letter was dated yesterday. Surely they can't be allowed to do this

    i have been waiting now 3 weeks so have sent another letter saying they have 7 days or i take them to court!
    sent it it to the mysterious stuart higley so i wait in anticipation for his next response!

    Hi Everyone, I just wanted some advise. Last night I went through my 6 years of bank statements, and totalled £1,159.00 in charges. I have typed out my letter to Natwest and am now ready to send it with copies of the relevant statements.
    Here's my dilema, In the last year NatWest have been more than helpful with our account, they have given us a good overdraft to help clear some debt we have, and we are trying to get rid of this in the next year. they also ring us when we are close to our overdraft limit so we do get into charges. I don't want to get their back up by sending this letter. Are they within their rights to close our account or stop our ovedraft ?

    I know we are entitled to this money, but just feel a bit guilty because they've been more than obliging this last year. Any advice would be appreciated.

    They may close your account and ask you to repay your overdraft. No one can say for certain, but you need to be prepared in case they do.

    Rex, if you read my above post .. I have to ask you .. are NW just clutching at straws with their threat to Strike Out, or is it a legitimate concern that I need to worry about?

    .. just how far do I have to go with these Soul-suckers before they fold ??

  • ok i have started on the reclaiming bank charges front, i sent the request out for the statments/charges and have received them back. They were in a completely inappropriate envelope that burst open in the post and had to be gathered up by the post office and put in one of their see through bags! - i have totalled up what i think they owe me £210 without interest or 255 with and sent off the 7 day letter, there time runsout on monday. However i am unsure what to do next as i had a blonde moment and did not send the refund request as recorded delivery. As i have had no response do i send it again but this time recorded or go on to the next step anyway?

    I used to think that Cobbetts were pretty switched on over this process, but as I see more posts from different people, I'm beginning to think they are in disarray and panic mode (much the same as the majority of banks and their legal representatives).

    For a legal firm, they know full well that CPR 18 doesn't apply in the small claims track. For them to send it is just plain bullying and/or incompetence on their part.

    The request to strike out because of lack of information from you rings a bell. They also put this in the AQ for the case I was dealing with. At each stage of contact with the bank, I sent copies of charges, and because the claim was issued at the local county court. The application had more detail than was needed (including two seperate lists of charges detailing the charges alone, and then the charges plus interest). Their claim for lack of information was completely baseless (as it looks like in your case).

    When the cheque for the full amount arrived (just after sending back the AQ), it was interesting to note the date on the cheque issued from the bank, and the date that Cobbetts sent the letter with the cheque. There was nearly two weeks difference.

    I really wouldn't worry about this company. I'm pretty certain they are going to cave in (after all, they have no real lawful basis to defend the claim).

    If you don't receive a reply within your deadline. Move onto the next step straight away. Try to send the next letter recorded.
