I got a letter offering me a refund of all my charges and interest (£1658). it still leaves my account o/d but it is within my original limit, which is now cancelled.
They want me to clear the o/d and close the account ( as I am staff)

I'll bring you up to date to where I am now .. I'm waiting for a court date having filled out my AQ as NW filed a defence ( .. as expected). The defence asked for CPR 18 Part 2, which doesn't apply to the Small Claims track anyway, so I wrote a letter to Cobbetts and told them so and that I'd bring it to the attention of the Judge as I think it's intimidation on their behalf. Today I got a copy of the NW's AQ to the Court from Cobbetts .. in the 'Other Information' section, they wrote that they might ask for the judge to rule Strike Out, as I hadn't replied to the information that they requested from me ( .. obviously CPR 18 Part 2, but they didn't say that in the 'Other Information' tab). I've just sent this to the Court ..

I have received a copy of the defendents Allocation Questionnaire today from Cobbetts.
I note that in ‘Other Information’, they have put forward the following information:
<< Case management Directions cannot be proposed until the Claimant serves a Reply to the Request for Furthur Information which was due on 18 January 2007. In light of this, the defendant may amend its Defence or apply to Strike out >>
May I please bring to the attention of the Judge that they have requested CPR Part18 from myself, however CPR Part 18 does not apply to the small claims track. I have written to them to inform them of this, as I am sure they were already aware of this when they asked for that information from me. I can only conclude that the request was designed to intimidate.
Cobbetts do have all the necessary information pertaining to this case that they have asked for, as my initial enquiries led me to get that information from my local National Westminster Bank branch long before I decided to bring a Claim before the Court and I find it hard to believe that the National Westminster Bank would not have passed that information on to them.
I find it disheartening that they may apply to Strike Out based on:
#1: Information that they already have, and
#2: Information which they knew beforehand did not apply to this Claim.

Hi All, My "Higley" day approaches, Nat West have only 2 days left to answer my request for a refund letter, so I am preparing for the next step. I have seen many of you refer to Cobbets, I kinda guessed that these may be Nat West's solicitors, is this the case? Also if you use an abbrieviation or TLA (Three Letter Abrievation) could you explain it at all please?

We sent the first statement request letter to NatWest two weeks ago this Friday. My partners account has been frozen for nearly a year during which time we have had no statements or correspondance with Nat West what so ever. Only today we have a solicitors letter (Green&Co) turn up saying that they have been instructed by Nat West to commemce legal proceedings against him in respect of an unpaid liability, unless we settle very quickly, which we are in no financial position to do! It does not even say on the letter how much he owes them. The last quarterly statement we had from them was April 2006 and he was just inside his overdraft limit which is only £1000. During this time he had £382 charges and nearly £50 interest! So you can see where it goes!!! The charges should easily put him into credit but I do not think they are going to wait, especially without having statements to see the true figurethey owe him.
Can anyone please give me any advice as what to do next?

You need to tell them the debt is in dispute. If a debt is in a legal dispute, they cannot enforce the debt. At the same time, start the process of reclaiming your charges from the bank.

Hi,
I'm going to reclaim my charges on my account from Natwest, but am in difficult position.
I am a final year student, only 5 months to go, and although I am not overdrawn, (at the moment!), I seem to be having trouble opening up a second account with any other bank. Halifax refused me over the net. The bank I would prefer to use is CO-OP or Smile (for ethical reasons) but you need more than 6 months left on your course. I would prefer to get on with claiming asap, as the money will come in useful when I graduate. (My boyfriend just got over £900 back!!) However, it looks like I'm going to have to wait until the summer.
Can anyone offer me advice on whether Natwest will close my account, and what the chances are of antheer bank accepting me as a student customer now? They will receive regular money, and another loan payment in April.

Just out of curiosity how come Natwest will take some people all the way to the court process and others (fortunately like me they pay out after the first letter)?0

is it me or this is taking longer than usual? well i sent my letter on the 03 jan, i received a reply saying
"Thank ou for your letter regarding charges applied to your account, we're currently concidering your claim and will respond to you asap."
that's like about 2-3 weeks later, so do i have to wait for another 2-3 weeks? :-s
