    Well just posted my first letter asking for a list of charges, 40 days to wait, fingers crossed. I have opened a new account and am moving all direct debits over to this. fingers crossed.

  • Hello folks,
    I sent 2 letters to Natwest claiming bank charges and the accrued interest; 1 for my private account totalling approx £800 and 1 for a business account totalling approx £7,000 (I know, I know. My ex wife and I were terrible at business and even worse with accounts).

    14 days later I received 2 letters thanking me for my communication re the accounts and that that they were looking into it.

    That was 2 weeks ago.

    Today I received a letter regarding the business account, addressed solely to me, even though my ex wife and I were in Partnership and were both signatories on the account. The letter recommended that I contact them within 7 days and make arrangements to pay the balance of the account, £11,782.03 (£7,000 of which is made up of bank charges).
    [We had a large overdraft as our business was seasonal and Jan/Feb was famine time, so we were always a good way into our overdraft this time of year. Business in March was always good enough to clear the overdraft and then some].

    No mention of my private account and the charges on it.

    I know they're trying to intimidate me but frankly I'm feeling too defiant to be scared. Having said that though, I'm not sure what my next step should be.

    Pearls of wisdom will be greatly appreciated.

    Looks like you could be up s**t creek without a paddle mate....

    They have the right to close your account if they want, and if you are claiming £7k back then I can't say I blame them, so £11, 782 - £7k = £4782 that you are going to have to pay back...

    Hope you can afford it!

    If you are happy to continue with the process, then go for it. You should contact NatWest and tell them, part of the amount is in dispute because of the charges. They may give you a timeframe to repay, again you will need to judge what to do if they put this in the hands of a debt collector. If the debt is still in dispute, it should not be enforced. Obviously you still need to come up with the difference between the charges and the total debt.
  • Repaying the difference is not a problem, in fact the full sum will be resolved in the next 4 weeks, in line with closing the business down. My main concern is what my next step in terms of what I say to them. Do I just send the 3rd letter demanding full payment or risk me taking it to court...or is there another tack I should consider?

    No, just follow the procedure and send the final letter, it sounds like their attempt to intimdate you will be in vain.
