When the 14 days are up, send them the second letter, when the next 7 days are up, start the court claim.

Just because you have had a repsonse stating that they are looking into it, it still means they only have the 14 days to do so. Unless you decide you want to give them more time of course.

Thanks it's what i was looking for. I noticed you're also in the same position with 4 days remaining. Is there a template to send as a third letter before the court claims?

Best of luck with your claim
  • There are templates on the main thread or you can go to Consumer Action Group, who also have templates. I need to update my signature, as i sent the 2nd letter yesterday RD and it was received today, so they have seven days from yesterday/today to respond. Court claim to go in next Wednesday if i have not heard anything.

I have just started the process of reclaiming charges back from Nat West for my daughter's boyfriend. He feels quite intimidated by the bank and I have therefore offered to pursue this by sending a letter of authority from him asking them to correspond with me. Do the bank have to acknowledge that he has given me authority to do this for him. Also, I have totalled up his charges which amount to three thousand pounds and the interest charges from the bank are in excess of four hundred. I have put these separately on xcel sheet but can you claim back the interest charged by the bank as well as the charges. Does 3000k sound excessive on an overdraft that initially started at a couple of hundred pounds and which is now 800? Would really appreciate any help - complete novice but have been using the template letters which are bril!!! Nat West just seem to be piling more and more charges on his account at the moment almost 300 in under a month!! For someone on basic wage this is just spiralling out of control for him and making him extremely depressed - shame on Nat West eh!!!
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    Hi All
Well 14 days up today and no news from Stuart Higley ( the famous Stewart, please bear with us Higley). So I have sent my letter before action.

Fell a bit nervous now, despite becoming addicted to this site, I can not work Nat West out they seem to be very random in their responses. Knowing my luck I will be the first they take to court.

I keep telling myself I have nothing to loose, Nat West already have all my money. Also it will be the first time in years I have been in the black if I am succesful, I did think I might regularly write to the bank telling them that I am in the black, or have sufficiant funds to pay bills. Then charge them £38see how they like it.

I intend on sorting all my cards and loans next, I am getting a bit ahead of myself, but I can't wait for the day I am on the debt free role of honour site.

    I will keep you posted.

  • Can anyone please help me? I'm a studnet and interested in reclaiming my bank charges however I believe that by law you can only open one student account at a time. I am worried that if I proceed and natwest close my account then I will have no way to clear my overdraft without having another account in place?

    Thank you:confused: :
  • Summary: Two Natwest claims sent with provisional figures on December 14. The requested £10s-worth of statements arrived in their tatty brown envelopes either side of Christmas. Still no reply by New Year so LBAs sent December 31, with definitive figures.

Bank sent holding letters in response to December 14 letters saying will respond as soon as possible. Their next 14 days notice expires Saturday so it's likely to be of to MC On-line Monday am. Already registered for MCOL and parachutes are in place as a precaution.

Update: MCOL buttons pressed today on both claims into Smersh HQ. Still no definitive reply to complaints. Meanwhile more !!!!-ups at Natwest - how can anyone be this incompetent? They managed to pay a direct debit (to themselves) after I had cancelled it and after I had already paid of the balance. Now trying to get that refunded but getting the usual mushroom treatment. Also sent a courtesy letter to the branch, which is more than they've ever done for me!
