Im just writing to Natwest Credit Card to reclaim £144.00, and am offering them the without prejudice option of paying me £100 but the account in question is closed, do i need to point out that if they were to take this option they would need to pay me by cheque or transfer to my existing bank account? or does this look a bit cheeky and wait to see what they say first?

In my post yesterday I received an offer letter from Natwest together. In the same post I received a letter from their Solicitors enclosing a copy of their defence and confirmation the same has been filed with the Court.
I thought I would go all the way when I started my claim but I am now considering their offer. There is a difference of £867.81 between their offer and my claim (which mostly comprises of the interest and court fee).
Does anyone have any tips regarding negoiation of the offer? The letter does say I can 'call to disscuss further'
Has anyone been successfull in having their offer 'upped'?

Now is the time to make use of that interest as a bargaining chip. You aren’t legally entitled to it unless it is awarded by a judge, so you can afford to sacrifice it.
The Golden Rule of any negotiation is that you never let your adversary know how much you might settle for. Thats for them to offer. Its like an Arab market, but in reverse - you start high, they start low.
The ideal outcome is that you convince them that, if they let this chance of a settlement slip through their fingers, it will cost them at least £x in interest. If you settle on the charges plus court fees, they can say that they got away with less than you were claiming, whilst you can say that you got everything you were entitled to.
Even if the worst comes to the worst and you cannot reach a mutually acceptable figure, it will do your case no harm whatsoever when the judge sees that you have taken the initiative and tried to negotiate a settlement and avoid having to take his valuable time.

Okay, I finally got a response from Natwest about my Credit Card charges. They sent me.... ANOTHER LOT OF CURRENT ACCOUNT STATEMENTS!
Gah!
It seems like they cannot read past the first 4 words of a document.0 -
I wonder if anyone can advise me, i have trawled through loads of threads on here but i cant seem to find anyone else who's had the same response as me.
I am claiming back just over £5k including interest from Natwest, they ignored the first letter as normal, then responded on the 14th day to my second letter saying they were looking into my claim and would respond in.... 6 to 7 WEEKS!!!
Surely this is not an acceptable response? Should i just go ahead with the Moneyclaim? Or write to them saying that timescale is not acceptable and if i do not receive a response in 14 days then i will take them straight to court.
Any help much appreciated as i dont want this to drag on and on!0 -

Got a nice surprise this morning when i phoned to check my balance with Natwest, turns out they refunded not only the original amount of £2382 but the extra charges I had incurred since the start of the claiming totalling an additional £480. Therefore the total amount I have successfully claimed from Natwest is £2862.00.
I started my claim in April when I sent the first letter requesting my statements, got these back relatively quickly and recieved no charge.
I then sent the second letter asking they return these charges, at this point I received no response although Natwest claim they sent me a letter saying they were looking into my claim which i have not received to this day.
I sent the LBA at the end of the 14 day timescale and followed this up with a phone call where they stated they had 56 days to respond and gave me the date of 7th June as the deadline.
Admittedly I strayed from the timescale as I waited for this date to arrive but had several conversations during this time where Natwest confirmed they would be refunding me the full amount.
Bang on deadline day, 7th June, the settlement letter offering to refund me the full amount dropped through the letterbox.
After receiving this, I rang my local branch to send me the relevant charges incurred since the start of the claim which they duly did within a couple of days, again with no charge.
When this was received and calcuated to an additional £480, I wrote a note at the bottom of the signed settlement paperwork stating that "Although I was happy to accept the amount I would like the additional charges reviewed and added to the original claim, forwarded this with a copy of the charges as proof.
A week later (Today 15th June) Natwest confirmed that the full amount had been credited to my account and surprisingly left my £1500 overdraft in place, although i cleared this immediately, they said that they were leaving the account in place but should I decide to reclaim in the future they would consider my account options.
No problems there, won't be making that same mistake again.
I'd like to thank Martin and all the individuals who have personally helped me along the way, in particular Kurthamster who has offered me great advice on a number of occasions.
Hopefully this is the first of many, I have sent a letter to ABBEY asking for my money back who have responded saying they are looking into my claim, I have also sent a letter to CLYDESDALE requesting the same but am yet to receive a response.
Once again thankyou to everyone on the forum whose advice has been priceless and i'm sure i'll be needing future advice whilst pursuing the other two claims.

Hi Everyone,
Just letting people no that Natwest offered me a settlement figure and I decided to accept. I was only claiming around £250 including interest and their settlement figure was around £220 so thought what the hell? :j
I was told that in line with FSA regulations they had 56 days to reply to my original letter. I went along with this and fair play to them they were only a day late.

Long time lurker, just wishing to vent some frustration.
Everything was going along nicely. Applied for statements end of March. arrived within 2 weeks. First template letter sent 14/4/07, reply within 7 days advising they would look into it.
Called 2 weeks ago today to be told my claim was validated & an offer letter would be sent within 7 days.
Called last Friday as nothing received, told it was sent 1/6/07, but they can take a few days.
Called Monday 11th, told they would resend the letter, called wednesday 13th told no letter sent on Monday, but confirmed a letter sent 1/6. asked for a new one & told I need to wait until today to request again as that would be two months.
Read this site on wednesday night & realised that was nonensense so called Kathy (who's number was a welcome sight on here), who seemed genuinelly helpful, explaining that whilst a lot of offer letters were requested on 1/6 they are taking up to two weeks to arrive & I should wait until today as if they request it again it is likely to take the two weeks to go out again.
Get home today & of course no letter.
From reading bits & pieces on here it seems there was a batch of letters requested on 1/6, so why do dome take a day or two & others take two weeks & I resume others are never received. i work in an admin role & if someone doesnt receive a letter you hit the print button & post it again surely:mad:
Sorry for the lengthy rant, just very frustrated. Hoping some kind of karma means it shows up tomorrow I guess0
