Hi all,
Have been reading the forum for some time, partly for updates on GnatWest's manouevres, but mostly as a support to see people's success stories while my claim progressed. And now I'm sooo happy to post my success story!!:j
Issued the regular template letters found on this wonderful site, but because I couldn't/can't afford the MCOL fee, I (begrudgingly) decided to allow the eight weeks to trundle along, before considering my actions...
... and now, five days before the eight weeks are up, I've received the stock "We don't agree, but as a goodwill gesture blah blah" letter, offering me £1,030 - just 20 quid short of what I was claiming!!! Needless to say, the acceptance letter has been signed and sent back recorded delivery!
So, to all those still waiting, or indeed just starting out, I have this to say - stay strong, don't give up, and believe in this site. You WILL win. Thanks to all those here who have, without knowing it, kept me going too.
N.

Natwest have finally decided to pay up all the charges excluding intrerest and court fees. But I am stuck as to what to do with my case which has already been filed to the courts. It is currently acknowledged by Natwest but as i do accept their payment of offer how do i withdraw it??0

It's up to you really, whether or not you decide to accept their offer or not. As it's now in the court system, you are entitled to claim interest and your court fees. I'm pursuing my claim through MCOL (their offer arrived a week after I'd filed a claim on MCOL, having ignored all my previous letters) - by that point, I'd spent £120 on court fees which I want back, plus the interest. Obviously I now have the stress of wondering when the case will come to court locally, and what will happen - I personally have decided to press on with it.

As tempting as it is to go all the way I don't want to risk losing out on money which is needed right now. But to reiterate my previous question as i have accepted the offer from Natwest how do i withdraw my claim from the courts?0 -

Well, I first looked at this a year ago. Natwest had taken £5640 of bank charges from me in the space of 5 years. Sent a couple of letters. Got the usual "you were aware of our terms and conditions" letters back and gave up due to a lack of funds to go to small claims court. Mainly due to the fact that Natwest had been taking most of my money for a long time!
I started again in March of this year. Finally did the court paperwork online and paid my £250, so with interest etc the claim is now for £6.5k. They offered me £4k a week after I filed the claim, although the letter was dated 2 weeks prior to that. I decided to turn it down as they had been messing me around for so long.
Tomorrow is the day I can click the JUDGEMENT button on mcol. Well, I will probably stay up tonight and do it at 12.01! I'm not entirely sure about these things so I am trying not to be too excited in case there is still some way they can file a last minute defence, but I'm hoping not. So fingers crossed.
I have been lurking around this site for a long time and just want to say thanks to everyone that has posted here. It has been a great help and I really appreciate it!0 -
Evenin' All !!
OK, maybe I'm being thick! I've worked out how much I'm going to reclaim from Natwest but I can't see where to send the first letter asking for my money back. Someone please help as I've got the letter here ready to send off!!
Also, along with the letter I'm sending a spreadsheet showing on what date each month over the last 6 years they placed a charge against me, is this the correct thing to do??
Also, going back six years from todays date, when do I go back to? 2001 or 2002??
Thanks in advance guys.0 -
Please Help...I cant even see where I can start a new thread so am posting here...sorry if wrong place but I have just had statements back from Lloyds TSB for my fiance, they have listed all the charges since Sept 1 2001, they amount to £2229 without interest. We would be happy to get that back and do not wish to push for the interest as figure they may be more accomodating that was, but has anyone tried to compromise and maybe increase chance of a payout by deducting a reasonable charge for each of the transactions as I gather they are allowed to charge something but something reasonable say £3.50 a time? have worked out that if we deducted £3.50 for each then we would still be looking at just over £2000. Would this be likely to increase our chance of a payout or would it be an admission of 'guilt'...has anyone done something similar? Also why have they only provided statements from 01 Sept 01 onwards when we asked for 6 years which would be from May 01 onwards?? Their letter says they have provided charges from 'date you opened account or 1st Sept 2001, whichever date is most recent...is 01 Sept the magic date or something???? Thanks in advance for any help!0

I just wrote a letter ,asking to withdraw my claim quoting reference number and pointing out that Nat West had settled my claim
Mind you this has just reminded me that I have no reply so I had better ring them0
