  • hi smudgemanc26, i was over the moon, but they appear to be playing up again, phoned them today as told to do to see if they had received my letter, and they are still saying no, she even told me to phone back at the end of the month..... so here i go again. can't understand how some people get there money quickly and others it takes forever...

    Hiya

Did you send it back recorded? If so have you used royal mail online tracking to see when it had been dispatched.

I remember receiving my offer letter on a sat so i posted it first thing monday morning by special delivery (arrive by 1pm) i think it is it was only £1 something which i couldnt understand as recorded is about the same price? anyway i looked to see when it was dispatched and it was the day later from the borehamwood depot and by thurs i had the money credited to my account.

It might be worth you checking with royal mail online just to see.

Sorry to hear you havent actually got the money in your account yet. Once again natwest's system is rubbish!

Hi guys. Any idea how long Fatwest are taking to make offers? Is the first offer usually a good one?

    Hello all,

I sent a letter to Natwest on 25th May requesting just under £1200 including interest, no reply, surprise, surprise so sent another letter 14 days later, no response. So thought i would ring the customer relations department on 17th June. They recv'd my 1st letter on 4th June and decided to give me £951 (which is just the charges), which i am very happy to accept.

However the nice man on the phone told me it would take 8 weeks to send the letter for me to sign to accept this and a further 10 days to have the money credited into my account, why does it take a bank 8 weeks for someone to press a button on a computer to print a letter????

Anyway my question is does it normally take 8 weeks for me to recieve the letter or are they now working faster, as i could really do with the money now!

Would i get the money quicker if i went through with the court case?

I sent a letter off to Natwest recently (the one from this website) requesting my bank statements for the last 6 years and enclosed a cheque for £10. Last week I received bank statements for the last 6 months instead. Are they trying to fob me off? I'm really annoyed because I will have to write to them again and wait another few weeks for the rest of the statements and probably have to pay another £10. Not happy. Can anyone advise?

Don't panic. At least, not yet. It seems that some data is on computer, and then not all on the same system. Some older data is still on microfiche. I suspect that, when they get a batch of data, they send it out rather than risk keeping it to try and amalgamate it with the rest, and end up losing it.

I had the exact same response and they were true to there word. They responded with a full settlement to my claim within the 56 day deadline.

If they are willing to pay the full amount, there is no need for you to go to court as the bank is already willing to settle, the judge probably wouldnt be too impressed and this may work against you.

I understand that the urge to get the money immediately after they have already confirmed to settle is massive and slightly frustrating but my advice to you would be would be to wait and you'll get your money.

    Well Done!!!!

NatWest send the statements out in batches so there is no need to write again unless this is beyond the 40 days they have to send you the information.

Natwest/RBS work to an 8 week reply system in date order and you will get your letter in due time. I would suggest this will be somewhat quicker than taking them to court.

(NAT WEST) I have received a defence requesting further information and clarification.

Please can someone explain what I need to send them, in plain simple english if possible

2.3 In relation to each charge, please clarify the following: (a) is it the case of the Claimant the same should not have been charged? (b) if yes; please explain why the Claimant contends that the same should not have been charged? (c) if no; is it the case of the Claimant that the same should not have been charged in this amount? (d) if yes; please explain why the Claimant contends that the same should not have been charged in this amount and identify the sum the Claimant contends should have been charged. (e) if no, please state the Claimants case.

3 In your claim you state that the charges are: "an unfair penalty under the Unfair Terms in Consumer Contracts Regulations 1999"

Please specify all of the facts relied on by the claimant in support of the contentions in paragraph 3 above, and in particular please identify the regulations of The Unfair Terms in Consumer contract Regulations 1999 ("The Regulations") relied upon by the claimant in alleging that the contractual provision(s) referred to are unenforceable.

I would appreciate the help of someone who can explain what I need to do with this. Please either post back on this site or alternitively, email to [EMAIL="p.thornes@btinternet.com"]p.thornes@btinternet.com[/EMAIL]

    Hi there,

I had the same response from Cobbetts, it's all just hot air designed to intimidate you. You don't have to provide any information unless the Court asks you for it, so in theory you don't have to reply. But just to show the Judge that you are willing, a quick letter back to them wouldn't go amiss. My reply was:

    Dear Sir or Madam,ffice:office" /><O:p></O:p>
    <O:p></O:p>
RE: Me V NATIONAL WESTMINSTER BANK PLC<O:p></O:p>
    Claim No: ***
    <O:p></O:p>

I acknowledge the receipt of the Defence posted on behalf of National Westminster Bank plc (your letter dated 15th May 2007, your ref: LYS/RR01362-4256).<O:p></O:p>

I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative.<O:p></O:p>

Furthermore, I consider that the CPR Part 18 request is intimidatory and I intend to bring this intimidation to the notice of the court.<O:p></O:p>
    <O:p></O:p>
    For clarity, I contend that:

    a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit.

    b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law.

    <O:p></O:p>
Also, for clarity, I confirm the charges I am claiming were applied to the following account:

    Account Name:
    Account number:
    Sort Code:

<O:p></O:p>Please also find attached a breakdown of all charges I am claiming.

    <O:p></O:p>
    Yours faithfully,<O:p></O:p>

    <O:p></O:p>
    <O:p></O:p>

You won't need the CPR 18 bit as they haven't mentioned it, but hopefully this will help you.

    Good luck!
