I have received a defence letter from Cobbetts and also requesting information. I phoned them up and they said that I simply need to provide a comprehensive list of charges.
Should I just take their word for this? Are Cobbetts acting on behalf of the Nat west bank and therefore may give me incorrect information ultimately nulling my claim?0 -

They will do all they can to stall things for time, and to try and intimidate you into pulling out - but have none of it!! They are acting on behalf of Natwest and should therefore already have you list of charges that you've sent them already. There's no harm in sending the list to them again, with the "For clarity" text in the letter above (just re-emphasising that you're questioning whether the charges reflect the actual cost to Natwest). Doing this will show the judge you're doing all you can to settle the dispute. (Don't forget to send it by recorded delivery!).

I spoke to Natwest last week and they said it normally takes 10 days after they had recv'd your letter back.Started slimming world 4th November 2010
Starting weight 13st 4.5lb

As I had heard nothing for over 4 weeks, I lodged my claim on Moneyclaim. Added on the interest - an extra £100! and costs. Then the next day a SECOND CLASS A4 envelope arrived from Natwest. They offered me almost all of what I claimed. Had it have arrived a day earlier / been sent 1st class, I would definitely have accepted it. I rang Natwest CR Dept and they said there's nothing they can do as I have taken court action. Instead of £250, the claim is now £400.
They have just filed acknowledgment and are defending it. they now have 28 days. I am going to write to the court to add on this info in case I look unreasonable.

MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -
i received a letter back today stating
'thank you for your letter regarding the fees applied to your account. we are currently considering your claim. given the work involved in assesing your claim we anticipate we will be in a position to respond within 6-7 weeks, but will endeavor to do it sooner if we are able to'.
Anyone else had this? If so, what do you think the next move would be. sit and wait, or apply pressure?

I had exactlythe same letter 2 weeks ago. thought I would give them the benfit of the doubt and sit it out for a bit then chase. ||Most cases dont seem to take as long as this - so hopefully I should hear soon. You are prob about 2 weeks behind me in the queue I reckon. Good luck.0 -

Please can someone explain what I need to send them, in plain simple english if possible
2.3 In relation to each charge, please clarify the following: (a) is it the case of the Claimant the same should not have been charged? (b) if yes; please explain why the Claimant contends that the same should not have been charged? (c) if no; is it the case of the Claimant that the same should not have been charged in this amount? (d) if yes; please explain why the Claimant contends that the same should not have been charged in this amount and identify the sum the Claimant contends should have been charged. (e) if no, please state the Claimants case.
3 In your claim you state that the charges are: "an unfair penalty under the Unfair Terms in Consumer Contracts Regulations 1999"
Please specify all of the facts relied on by the claimant in support of the contentions in paragraph 3 above, and in particular please identify the regulations of The Unfair Terms in Consumer contract Regulations 1999 ("The Regulations") relied upon by the claimant in alleging that the contractual provision(s) referred to are unenforceable.

Seems to be a pattern with Natwest - similar happened to me. An undated letter arrived a week or so after I filed on MCOL offering me my charges back. As I'd then incurred £120 court fees, I wrote to say I would be continuing to claim the full amount through MCOL, and pointed out in my letter that their UNDATED offer letter had only arrived after I'd commenced my claim, and that I'd commenced my claim as promised within the timescales I'd set out, due to them not responding to any other letters.
Sending an undated offer letter like this is very sneaky tactics - I wanted it clear, in writing, what they'd done incase I have to go to court.
