    :rotfl:just received the standard letter from Cobbetts filing for defence
    This is very odd as about 4 weeks ago Natwest paid me in full the money they had taken from my account and i had canceled MCOL
    I called Cobbetts spoke to a very nice lady who had a laugh with me at the banks expense as the Natwest hadn't even told them that they had paid up (which I think would have been a somewhat better defence than the standard we are not doing anything wrong one).
    I also called MCOL to make sure they had cancelled my case which they had before Natwest had even acknowledged it

    Basically this goes to prove how inept the bank really is

    So anyone who has had this letter dont give up because of the implications of going to court the bank is running round like a headless chicken at the moment THEY HAVE NO REAL DEFENCE otherwise they wouldnt be paying up so often without even trying to go to court
    Also if you need an argument for your case surely the fact that they are paying out in full to so many people is an admission of guilt.

    You can add additonal charges on up to the point of filing your claim at court or MCOL.

    I was charged over £600 in the six weeks or so that it took Natwest to make me an offer I called them and they said when i write to accept the offer to put in a letter stating the additions I did so and they were paid along with the original offer into my account 5 days later this of course was a lot later than my MCOL claim which didnt include the extras
    I get the feeling Natwest make an offer shortly after you claim on MCOL if you accept it its up to you but if you can call them you will get the extra charges refunded as well (by the way I didnt claim interest on my charges i dont know if thats what spured Natwest to make an offer)

    I've read of many here who've received an offer for the amount of their charges AFTER they've filed on MCOL, which happened to me. As you say, its up to us to decide whether or not to accept it.
    It cost me £120 to file my court claim, and I wasn't going to give that up. I did phone Natwest to see if they'd up their offer but got a flat refusal - the person I spoke to was very abrupt and snotty.
    After writing to say I wouldn't accept that amount, they promptly filed a defence and I've had the usual stuff from Cobbetts, which I dealt with.

    I'm just wondering whether, if it ever finally gets to Court, that the fact that they offered me the almost £1000 charges refund (even though they called it a 'goodwill gesture' will help my cause in any way i.e. they acknowledged and offered to refund the charges, even though they dressed it up by another name? Any thoughts, anyone?

    Am getting soooooo cheesed off with the whole business. I'd have been happy to accept their 'goodwill gesture' if they'd sent it before I filed on MCOL. This has been dragging on for 3 months now. If I knew back then what I know now, I'd have gone via the Ombudsman. I've claims to make against Halifax, but have decided to go via the Ombudsman this time!

    Morning all

    I'm claiming on behalf of my dad after successfully getting my girlfriend's and my own charges back. I sent the statement request letter and Natwest took the maximum 40 days to send the statements but after checking through them all they have only provided them from October 2002 - May 2007. So this is a potential 17 months of charges he's missing out on.

    What should be my next course of action? I wasnt too keen on sending another request and Natwest taking another 40 days to respond.

    Any ideas would be much appreciated. Thanks

    I'd march down to your local Natwest branch & give them grief, they are just trying to stall on everything now, I'd demand they print out the remainder there & then & tell them they have had your £10 so you wont be paying again! If it isnt so local get on the blowe & threaten them with the FO ;)

    Hi Pam, Im sure we are 2 of a kind, every bank your chasing Im chasing!! What happens to you in relation to these charges happens to me!

    The only dif is you give better advice than I do :D

    I would have thought that any offer they make is a bonus to us though as you correctly pointed out they are pretty much admitting they took the 'P' but they call it a goodwill gesture, if it was just a 'goodwill gesture' I may start asking banks that I havent banked with if they will send me a 'goodwill gesture' as thats all it is :rotfl: :rotfl: :rotfl:

    GOOD NEWS!!

    New tactics from Natwest - I recieved offer 19/06, despite the deadline for them to file defence with MCOL only being on 25/06. I decided to sit it out a few days, and guess what..... a cheque for all the money I have claimed has arrived this morning!!!!!! (with one day lee-way for them to defend!!!)
