    GOOD NEWS!!

    New tactics from Natwest - I recieved offer 19/06, despite the deadline for them to file defence with MCOL only being on 25/06. I decided to sit it out a few days, and guess what..... a cheque for all the money I have claimed has arrived this morning!!!!!! (with one day lee-way for them to defend!!!)

    Bhoog, did that include interest aswell & if so what was the figure you were claiming as I think this plays a key part in whether people get an offer for the full amount or part of.

    I got all the charges and interest (£3.5K!) - I had recieved the offer minus interest and decided to sit it out until the deadline....and 1 day before the deadline, I recieved the full amount claimed (charges plus interest! There is no mention of court costs (£300), but in the grand scheme of things, I ain't gonna complain....so go for it!!!!

    I wrote my first letter to Natwest on 6th June with the final sentence being that they have 14 days to respond to my letter. They have not done so and I have spoken with them today on the phone and they have told me that they have 40 working days to respond to my letter?!

    They said they were basing this on teh number of claims they are having to deal with. They told me 9th August I would have a response.

    Should I accept this or seek further action? If so, what?

    Any help greatly appreciated.

I've claims to make against Halifax, but have decided to go via the Ombudsman this time!

    :rolleyes: Iam in exactly the same situation, had the same letter few days after i filed with MCOL and would have been happy to accept their 'good will gesture'. But i was'nt happy having to take them to court and it costing me money that i could do with. So When I rang them I got the exact same response (only she was quiet pleasent and not snotty, but sounded unsure of the answer to give) its nice to know that I am not the only one out there who's had this response. Just baffles me though, surely it's costing them more than our court fee if we are willing to accept :confused: what with all the solicitors fees and that, and they end up paying out anyway. I think it's just another way of drawing out the process, but why??

    Well more news, have contacted Cobbets to see the progress of my claim and they have now told me that they have requested the statements from Natwest to check that the amounts I am claiming is correct. Has anyone else have this? I think it is a stalling tactic any suggestions. Claiming £6000 inc interest.

    They are responding to letters but as they have told you 40 days. Some people are getting offers like i did but others get the sorry our charges are fare letter, and it's a long time to wait to be told that. Then again it may take longer than 40 days to claim through the courts, so i suppose it depends on you really. I decided to put the time in and go the court route sorry i can't be more help, all I can say is if you are prepared to put the time in and go through the courts chances are you will get your money waiting for them to responed to a letter is not a sure way.

    Money cleared into our account today :j :j- our first letter asking for refund of charges dated 17th April. I suspect some of the bank's tactics are aimed at imposing their time frame on account holders as they know we've been advised to stick to our 14 day deadlines.

    It must be small consolation for them to make us wait an extra 28 days or go to court - they know they'll have to pay up eventually so they want us to suffer.

    I've heard that Lloyds TSB have set aside £145,000,000.00 - that's One Hundred and forty-five million GBP - to repay all the unlawful charges. Howzat?:T

    Still no letter. A further 3 phone calls all advising they would resend it. 2 emails not responded to.

    Has anyone else experienced this? Are they just deliberately stalling or am I being too hasty?

    Should I instigate court proceedings? Contact the ombudsman? I just dont know what to do now. Everyone has confirmed the offer has been validated so why is it so difficult to print off a letter & stick it in an envelope.:rolleyes:

    Rang again today. Another different member of staff, who told me my call on Wednesday had been logged as requesting another letter. She went through the spreadsheet showing letters on order & its not on there. She claimed this could mean a letter has been sent as it only shows pending letters, but there was no way of telling.:rolleyes:

    I then requested the procedure to send a letter & told it goes through about 5 different people, one to request it, one to check it hasnt been sent, one to check the details again, one to check I havent already been paid & then another quality check....for one letter they have allegedly already sent:mad:

    She is requesting another duplicate, so another 7 days apparently.

    Off work next week on holiday & had been hoping for a little windfall to enjoy myself, but doesnt look like its going to happen does it:(

    I wish I work out out - there's no logic in any of it, to me, and no pattern. It seems just to be the luck of the draw who gets letters with offers in the within the deadlines, who's able to file for a judgment, who gets Cobbetts letters, and who has to go to Court. They're obviously going to drag it out to the bitter end with me :confused:

    Thought i'd let everyone know I have had 2 successes with Natwest over the last few days. First my husbands claim of 1880.00 was paid in full, took approx 6-7 weeks from first letter requesting charges back. Then my account,offer of full amount 222.00 offered within the same amount of time.

    Just a couple of pieces of advice.

    You can get your statements sent for nothing. Phone customer services on 08456013399, ask for the lending department. They sent them out for free and only took a week to arrive. In 2 seperate batches because of the RBS takeover.

    Also, I know the advice is to stick to your timescales but it seems to me that people are fileing MCOL at a high cost then getting offer for full charges within days. I do not believe they are being cunning with this but are just honestly taking the requested amount of time to deal with claims. I personally would sit and wait, saves money and a long drawn out process with Cobbetts.

    Money was in both accounts within 5 days of them recieving acceptance.

    I want to thank Martin for all the great advice and template letters and also everyone else giving advice on the boards. You've been invaluble.
