Anybody at the same stage as me - court hearing a week on Wednesday? Iv sent my bundles to court and Cobbetts and havnt heard anything at all as yet. Finger nail biting time!!!!! Anyone else got to a week within the hearing and been paid out by NatWest? JGNat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -
I have sent my claim into Natwest and am I right to be expecting a settlement figure within 14 days, If so that is tomorrow and I havent heard a thing. What do I do now?
Thanks0 -
Yes, 14 days is the standard limit for the banks to respond.
Follow the guide here to find out what to do if they do not reply to you.
As for me, I finally got my Credit Card statements, after 2 lots of Current Account statements sent to me (both the same), and 2 letters demanding more money (which I did not give them), I received my statements 1 day before my set deadline (40 days, plus 7 days final letter).
I haven't sent them off yet, because I have a couple of things brewing (annual review etc.) which I want to get out of the way first.
Do I have a time limit between receiving my statements and sending the claim letter?0 -

No there's no time limit as such - if you are still incurring charges then it might make it difficult to keep up with the total amount claimed.
NATWEST want 8 weeks (56 days) from start of claim to issuing an offer.
Martin suggests 28 days + turn round time for letters. I got everything I asked for but did not keep slavishly to the 14 day deadlines in each letter. I did point out that the 14 day deadline in my second letter (letter before action) coincided with the 56 days required by them and received my offer almost to the minute. It took a further 72 hours from receiving my acceptance for the money to clear into my account.
I didn't think it was worth the stress of dealing with extra forms for small claims court and correspondence with the disgraceful Cobbetts to try to save 28 days - going to court usually extends the time you wait anyway.
GOOD LUCK!:money:0 -
Hello all,
After some advice.
I sent my first letter to natwest requesting just over £3000 which £500 is interest. I phone customer relations today and they have recvd my letter and are in the process of actioning it.
I am 99% sure they will make me an offer, which i know will just be the charges.
So do i send the 2nd letter and wait the 14 days or just take them straight to court as i need the charges plus the interest to clear the debt i owe to them.
You must send the letter before action and give them 14 days before you start court action.0 -

No bank will send a settlement figure within the first 14 days. You can send the letter threatening court on day 15 or you can wait and see what NatWest reply with as you can see by previous posters they will send you an offer of your charges within 7/8 weeks.0 -

Hello all, I am now totally at my wits end!! My bank (natwest) have entered their defence saying they were 'embarrased' by the lack of particulars in my claim - can someone please help me and let me know where I can download a Kick A** template form to send to the court so they know that I mean busines?? Thanks in advance!! :O)
Hi Lisa
I too received the same defence from Cobbetts back in May regarding the Particulars of my Claim. I was fortunate enough to receive the correct advice of going to my local court and applying to amend my original Particulars. It seems daunting to begin with, but after a lot of research I was able to put together the correct wording and more importantly refer to the correct legal statutes etc. I've just heard this morning that the judge has now granted the amendment and that new papers are being served on Cobbetts today. It cost me £35 to amend the paperwork and I had to fill in a new N1 form along with an N244 form. Take three copies of each to the court with you.
My advice is, don't be intimidated and don't give up. I decided rather than let Natwest/Cobbetts try and have my case thrown out that spending the £35 would save me from losing my intial £120 of bringing the case in the first place. My overall claim is for £4,500.
Good luck0 -
Just sent off the letters to try and reclaim £880 in bank charges. They sent me a two line letter back saying they would be in touch within 6-7 weeks
Is this time frame realistic or do I need to be chasing them for an answer or even the money ?
With Thanks

Hello,
You can wait if you feel it will be fruitful, but the advice here is stick to your timescales not theirs (would they have waited 6-7 weeks for you to get money into your account before they whopped a charge on you??). If your first letter said 14 days, wait until then and then send you Letter Before Action and continue like that. Don't let them bully you!0
