Although I agree with Nick.... the NatWest is part of the Royal Bank of Scotland Group and if you give them the time they ask for they will come up with an offer so as a compromise, why not ring the bank and ask them what stage your claim is at.

Well I stuck to my timetable and filed with MCOL, Natwest have responded and say they intend to defend all of the claim. What should I expect from them?

Nat West have acknowledged my claim, so now I have to wait another 14 days

I hope they don't defend, though it would be interesting to see them defending the charges...

Hi, I have sent a separate letters requesting the charges for my 2 Natwest accounts, totalling approx £7K for both accounts. I have received a reply from the bank not who have stated that the process will take approx 6-8 weeks to check my claim. This letter arrived after I had sent the court threat letter. Do I now continue with my timeline and go to the small claims court, or wait for the banks 6-8 weeks??
Please help, this money would really help!!
Hi Gemhew, just to say i reclaimed just under 4k from rbs, after following advice from posts on the rbs thread and also taking the advice offered by edinburghlass which was about waiting the 6-8 weeks and they usually come up with the right offer (our offer was the full amount we asked for, not including interest, offer was received within 7 weeks),both rbs & natwest are coming up with good offers, but it's really upto you whether you want to wait and see what they offer,GOODLUCK.:) P.S just to say the board guides are all absolutely wonderful :A
  • I have requested £2100.00 back from Natwest bank for charges (I didnt ask for interest as well)

They have replied and offered £1400.00 as a 'goodwill gesture'

I would like to write back and say that if they make it £1800.00 I will settle at that, if they say no am I still then entitled to settle at the £1400 they originally offered or will that offer be taken back if I first request to meet in the middle?

I've had another letter this morning, saying that the offer of £4,000 was in full and final settlement and would be paid into the designated account, which I assume is their account. It gives me another 10 days to decide.

The problem I have with accepting that is that £2300 of it will be swallowed by the overdraft on the account, so I will only have £1700 for other debts.

Obviously, this is better than nothing but if I were to wait with the court claim and get the full amount, it would clear ALL my debts. They have until the 2nd of July to file a defence. Now, in the letter they say I have 10 days. Does that mean working days? If it does, I could wait to see if they file a defence before I make my decision. Do they always file a defence?

So now I am unsure how to proceed. I know it is a scare tactic, but I don't want to come away with nothing and the thought of court does scare me to death, partly because I feel guilty for getting into the mess in the first place, even though the bank made it so much worse!!

Any advice or experience people have would be greatly appreciated!

Well, another letter. This time offering me £5,340. I think I will probably take it, but as they only have until Monday/Tuesday to defend I am going to wait and see if they do it. I am sure they will do it at the last moment again, but just in case...

Thanks for your help everyone! I will come on next week and let you all know what my final outcome is!
  • Hey, i'm new to this forum, but i've started the process of claiming back my bank charges but wanted some advice.

I sent off the first letter, and i've received a reply.

'Thank you for your letter regarding the Fees applied to your account.

We are Currently considering your claim, Given the work involved in assessing your claim, we anticipate that we will be in a position to respond within 6-7 weeks, we will endeavour to do sooner if we are able to.'

What should i do from here?

Do i wait, or continue with part 2 of the claim?

    Thanks!!!

The letters saying that they are investigating and will reply within 8 weeks are acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.

Your first claim letter should give them 14 days to reply. If you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter.
