    Its the same as anything really, how much do you want the money & how much of it is interest? I wouldnt bother with that No Win, No Fee carry on.

    For example if you pay £120 court fees then its likely that you will get your interest & court fees back when you win but if you dont want to go that route then take the charges alone, which Im pretty positive you will get offered.

    thanks Gareth - nice to know you are not the only one worrying about these things....do you know if Natwest are likely to close my acount down? I have another current account that I can use - is it worth moving DD and SO's now? Thanks

    I'm one day away from being able to ask the court to make judgement (on moneyclaim.com) becuase NatWest haven't defended it yet.

    Bit concern it's got to the 11'th hour.

    What I've seen so far:

    1. No difference (in the way the matter is dealt with) whether you send the letter to your branch, central addresses or even another branch, all the letters seem to come back from the same place.

    2. My statements were also sent in two packets, split around the 2002 mark.

    3. Even though I sent the £10 stat. max fee they didn't cash the cheque and wrote saying thay'd let me have the statements for nothing.

    Putting a call in won't hurt (some people have and it's speeded things up) it depends if you feel up to giving them a ring.

    If you decided to sit tight, Natwest have another 14 days (28 days from when the claim was deemed served) to enter a defence. You may hear from them before then - again, some people have received an offer during this time. There doesn't seem to be any consistency from our friends at Natwest as to when they settle.

    If you don't, and they enter a defence, the court will send you an Allocation Questionnaire to fill in and return, it's quite simple and there's advice on here on how to fill it out, but you will have to pay £100 for the pleasure. You'll get this back though as costs when you win.

  • I am currently claiming about £6150 from NATWEST and have been told by them that an offer will be in the post within a week. Problem is that in my original letter I claimed about £2500 going back to 2004 (I only had statements to Jun 2004) with a caveat that i would claim back further if I did not hear from them within 14 days. I heard nothing so in my second letter I claimed back to 2001 (NATWEST had sent me a full set of statements by this time). My question is will NATWEST offer me something near the full amout or will their offer be based upon my original letter?? If the latter is the case how do I go about getting the rest of the money? Do I make a new claim for 2001-2004???

    Na dont think they will close your account, from what I understand its extreme circumstances, Im the worlds worst customer to the banks but Im sure they would rather me waste money with them than anyone else.

    If you have a spare account then keep it open just in case, thats what I did anyway mate.

    My money is on them defending, this is a usual tactic of theres, sorry to say.

    Sit tight mate, its likely they will enter a defence in 14 days aswell, then you will get a load of waffle from Cobblers (their solicitors) then you ask us lot on here what to send back. You then get in the same boat as me waiting for it to be sent to your local court...

    its likely they will make you an offer in the next couple of days for charges only, they never offer interest or MCOL fees.

    See what offer you get first pimms, if you dont feel it covers the lot then go for more/the rest

    Hi all
    Just quick question. I called natwest as a follow up to my letter giving 14 days before court action, I was told by the lady I spoke to that a offer has been made. This was for the full amount (inluding interest) but that the letter has not gone to print. She told me they had untill the 20th july to send this. Should I take this as fact?

    hey there luker, thanks for your PM - thought I'd keep it out here for everybody to read :)

    You asked if they acknowledged my claim - well at the last day there was nothing on my doormat from them - so I guess I'll see tomorrow morning when I press the button on moneyclaim.com

    For your situation:

    Personally (and i do mean just for me) phone calls aren't worth the effort. Either you'll talk to something who can't help or you'll be talking to somebody quite skilled in the matter.

    Best keep everything on recorded sent by royal mail, may take longer but you;ll have a FULL trail. I say never ever talk to them back if they ring you up, I would fob them off saying "You can't prove you're the bank, write to me" they never do!

    Anyway, the advice here and I've stuck with it - it's your timetable, just keep applying the pressure, follow the steps in the article on here.

    I figure, that even if I wake up tomorrow and see they've acknowledged for a delay - I'll just sit it out until I go to court... can't wait TBH. :beer:
