i have just recieved my 3rd offer of £1700 when i have claimed in excess of £5000 fropm natwest should i take it or refuse? really not sue what to do0

i have never used a site like this, so if i have put this question in the wrong place, please let me know.
i'm not sure what to do next. i have written to my bank requesting bank charges back, two accounts with natwest, totalling nearly £4'000.00. i sent the first letter, then the second, using the template letters on this site. i was meant to take my bank to court on 25th may but at that time, i didn't have the money. then when i did have the cash, the first case where that guy didn't win came on the news. this really put the frightners on me and what to do next. i have every since been umming and arring as to what to do next.
the judge that said taking banks to court is a real gamble now put me off. i read on this website that you can either go through the courts or the financial ombudsman and they will deal with it.
please please someone give me some advice. am i better going through the ombudsman or do i have to take it to court now i have told the banks this.
help - what should i do

Its amazing how often Natwest offer their 'goodwill gesture' of the amount equal to charges being reclaimed (happened to me too) :rolleyes:
At this point, I think you need to weigh up the amount of charges you're reclaiming versus the amount its cost you to take them to court (plus interest you're reclaiming)
I did ring Natwest to ask whether they would be prepared to give me the court fee, and I'd forget the interest, but the snotty individual I spoke to said it was that or they'd defend my claim in court. I decided to pursue the full amount of my claim. My court fees alone cost me £120 and I didn't feel prepared to have to lose that amount of money.

I think the odds are still stacked in your favour that you'd win if you took it to court, but it IS stressful. From what I've read, the FO is very successful getting peoples fees refunded, even if it takes several weeks.
In hindsight, I would never have taken it to Court - but thats just my personal view and not meant as advice. Good luck with whatever you decide!

Thanks Pam. it is a hard exercise! My charges are £923, court fee £120 and interest about £300. Reality is, I need the money and not sure I want to handle the stress of waiting to go to court - if you know what I mean?
I may well try a call to Cobbetts Litigation and see what they say and if it's a no, I may have to return the form to Natwest. I have seen before people sign the letter but cross out the terms of the acceptance and accept it as part settlement - is this possible?0 -

Reedy, going on personal experience & the general posts on here it is likely that Nawtest will make you an offer about 14 days after you would normally file the MCOL, you will however only get offered Charges, they dont like interest.
Its the same as anything really, how much do you want the money & how much of it is interest? I wouldnt bother with that No Win, No Fee carry on.
For example if you pay £120 court fees then its likely that you will get your interest & court fees back when you win but if you dont want to go that route then take the charges alone, which Im pretty positive you will get offered.

Hello all,
After some advice.
I sent my first letter to natwest requesting just over £3000 which £500 is interest. I phone customer relations today and they have recvd my letter and are in the process of actioning it.
I am 99% sure they will make me an offer, which i know will just be the charges.
So do i send the 2nd letter and wait the 14 days or just take them straight to court as i need the charges plus the interest to clear the debt i owe to them.Started slimming world 4th November 2010
