Oh, that's interesting Cherry. And they accepted that and still gave you the part payment? How did that affect the court paperwork you had already filed?

I don't desperately need it, it will just sort out my debts, so I am happy to wait. But I don't want to end up with nothing either!

I know what you mean about the last minute tactics. They literally acknowledged my claim on the very last day. I was so annoyed.

Thank you so much for your support! It really helps knowing other people are doing the same thing!

That's the bit I'm still doing as they haven't responded to my letter yet. I'm still going ahead with the full amount in the courts. If I get a cheque for the part-payment, there's a section on MCOL where you can notify the court that you have received a part-payment, or you can ring them up.

It's in the bank's best interest to give you the full amount - if you accept what they've offered as part payment, that's as good as them accepting liability. You won't end up with nothing - look at all the success stories on this thread to keep your spirits up.

They sent me cheque for the full settlement on one of mine the week after they sent their defence. They claimed it wasn't cost efective for them to take it to court and this was a "goodwill gesture" :rotfl:

Just rang the natwest to discuse the offer that they have made. I told them I Had filed court proceedings the other week but would consider accepting their offer if they would refund the fee i'd incured to get this far. They said they had stuck to their 8 week time scale and wouldn't pay the court fee. I explained that i'd just had dealings with the halifax and they kindly agreed to pay the fee if i provided evidence of proceedings, and would they consider my offer. No joy i'am affraid looks like i'll be going to court, getting a bit scary now as i don't want to be un prepared

Good for you - stick to your deadlines and don't worry everything you need to prepare is on this site, or ask and someone will leap to your aid!

I thought I was a happy chappy due to me getting my cash back, but when I checked my bank account today ..the cheeky sods have only taken out more bank charges.
I was overdrawn by £67 (due to bank charges)and when the money went into my account ,they took this off me again.

I have now closed my account , and will never ever go back to Nat West
  • Hi all. I sent my first letter to Natwest on 11th June for about £2500 and am waiting for a response. Since then, i've been charged another £300 on my account. Does anyone know of a letter that can be added to the first one asking them to add on any charges that are incurred in the mid stages of a claim? Any help would be useful. I just want my money back - all of it in an ideal world!!!

You can add additonal charges on up to the point of filing your claim at court or MCOL.

Long time lurker, just wishing to vent some frustration.
Everything was going along nicely. Applied for statements end of March. arrived within 2 weeks. First template letter sent 14/4/07, reply within 7 days advising they would look into it.

Called 2 weeks ago today to be told my claim was validated & an offer letter would be sent within 7 days.

Called last Friday as nothing received, told it was sent 1/6/07, but they can take a few days.

Called Monday 11th, told they would resend the letter, called wednesday 13th told no letter sent on Monday, but confirmed a letter sent 1/6. asked for a new one & told I need to wait until today to request again as that would be two months.

Read this site on wednesday night & realised that was nonensense so called Kathy (who's number was a welcome sight on here), who seemed genuinelly helpful, explaining that whilst a lot of offer letters were requested on 1/6 they are taking up to two weeks to arrive & I should wait until today as if they request it again it is likely to take the two weeks to go out again.

Get home today & of course no letter.

From reading bits & pieces on here it seems there was a batch of letters requested on 1/6, so why do dome take a day or two & others take two weeks & I resume others are never received. i work in an admin role & if someone doesnt receive a letter you hit the print button & post it again surely:mad:

Sorry for the lengthy rant, just very frustrated. Hoping some kind of karma means it shows up tomorrow I guess

Still no letter. A further 3 phone calls all advising they would resend it. 2 emails not responded to.

Has anyone else experienced this? Are they just deliberately stalling or am I being too hasty?

Should I instigate court proceedings? Contact the ombudsman? I just dont know what to do now. Everyone has confirmed the offer has been validated so why is it so difficult to print off a letter & stick it in an envelope.

:T I submitted my claim for £1812 plus interest and had submitted a court claim via MCOL when I received an offer of £1812 from Natwest a day before their acknowledgment was due.

I decided to wait the extra day to see whether they did and ...............yes , they did!!!

Obviously, I was a bit miffed about this especially as I am in a DMP paying them back for my overdraft of £1427!! So, I was thinking I would end up with about £400 for my efforts less the £120 it cost me to file the claim with MCOL.

Anyway, before accepting the offer from Natwest, I called their collections dept and offered a full and final settlement of £800 for my overdraft (luckily my stepdad agreed to lend me the money) which they accepted!!!

So, now when I accept their offer I will have approx £900 after paying back the £800 to my stepdad and the £120 for MCOL. I also have one less debt to pay off!!!!

Just wanted to let you all know and say thanks for all the help and advice that I found on this site.

    Good luck to you all!!!:j

WoW! thats not many people considering the amount of claims they must be getting. I am quiet happy to accept their offer as they have offered me all the charges applied to my account less the intrest, only that they refuse to pay me the court fee which i should never of had to pay. They will end up paying it if it goes to court plus the intrest:confused: seems silly to me, you reckon it might be worth a call in the future? after all I'd rather settle than go to court and I thought thats what they would won't to do.
  • I did glean this info from someone else so i am sure of its validity. Yesterday someone who i had offered advise won £16500.00 by taking the bank to court. With the right advice and the right preparation you win. I am lucky, i have been on the losing side for a long time, and i hope it continues.
