    Please Help...I cant even see where I can start a new thread so am posting here...sorry if wrong place but I have just had statements back from Lloyds TSB for my fiance, they have listed all the charges since Sept 1 2001, they amount to £2229 without interest. We would be happy to get that back and do not wish to push for the interest as figure they may be more accomodating that was, but has anyone tried to compromise and maybe increase chance of a payout by deducting a reasonable charge for each of the transactions as I gather they are allowed to charge something but something reasonable say £3.50 a time? have worked out that if we deducted £3.50 for each then we would still be looking at just over £2000. Would this be likely to increase our chance of a payout or would it be an admission of 'guilt'...has anyone done something similar? Also why have they only provided statements from 01 Sept 01 onwards when we asked for 6 years which would be from May 01 onwards?? Their letter says they have provided charges from 'date you opened account or 1st Sept 2001, whichever date is most recent...is 01 Sept the magic date or something???? Thanks in advance for any help!

    Look at the pale blue bar at the top of the page you can search the forums for Lloyds TSB threads there and post your questions. At the moment we are advised to claim back 6 years from the date of claim letter. I wouldn't make any allowances or deduct anything from the penalty charges you reclaim - they'll probably try to offer less anyway and if you settle before court they'll be keeping the extra interest.

    PS I've just checked an old (1999) TSB account statement - they charged £55 for a returned DD - I'll have to look into this!!!!
  • hi chrissiesmoney, well i phoned them today as they had asked me to, to see if they had received my acceptance frm back, and surprisingly (not) they have not yet received it, she said they update there records on a weekly basis so i may get the money before there system is updated (i can't work that one out) i explained i posted it a week ago and she said that i should receive the money up to 14 days when they have received the letter, so i am still waiting..........

    Dammit , sent my offer on Friday , and i so wish id sent it receorded now !!!!!!!! Was hoping for it to be in before this weekend to be honest but it looks like theres no chance now !!!

    Have just received a letter from Natwest offering me £1812 as I am claiming this amount plus interest (approx £390). The thing is, I have completed the moneyclaim online bit and Natwest's deadline for acknowledging is tomorrow!! Should I accept the offer or wait till tomorrow and see if they don't respond.

    Also, If they do respond can I then accept the offer and halt the court action?? Not sure what to do... don't want to seem greedy but surely if they have made an offer for the full charges less interest, a court would award me the whole amount including interest.

    Sory a bit long winded but so excited/nervous!!

    Any advice would be greatly appreciated.

    Our offer of a full refund of charges as requested received Saturday am.
    I'm off out to return it recorded delivery shortly.
    Claim for £710.00 charges only.
    Letter requesting refund dated 17th April 2007
    Letter before action dated 29th May 2007
    Offer letter dated 7th June 2007

    No faxes, emails or phone calls as I have high blood pressure and don't need any more stress.

    Used Martin's templates but our final paragraph of the letter before action reads:

    "We look forward to a full response within 14 days as we will have waited courteously for 56 days by then, otherwise we will commence court proceedings to reclaim our money."

    No hurrahs, toasts or other celebrations YET as its not in our account. I'll post again when it is!

    Hi

    Congrats on the offer, only you can decide wether you want to accept their offer or not. If you want to accept you can cancel the court at any time by writing to them to confirm you have accepted the offer and advise the you consider the case closed.

    It doesn't matter of they file the defence or not. I personnaly would wait to see if they enter a defence, if they do you can still accept their offer (unless they have said anything about taking before the deadline). If they don't enter a defence then you will win by default the full amount claimed including court costs. Remember you will be losing not just interest but the court charges also.

    Thanks Wintye, I think I just needed to hear that from someone else!! Will wait and see if they acknowledge the claim tomorrow before doing anything else. Hopefully, as there was no mention of the court claim in the offer letter, they won't respond in time.

    Why does a day feel like a year when you are waiting for this sort of thing!!

    The fact that they might defend does not mean you have to accept their offer. Personally I would write to them and tell them that as you were forced to file a claim you will now be settling only for the full amount + statutory interest + court costs.

  • Hi all, please help.
    Have used moneyclaim to get charges back from Natwest approx £1800. I've received a letter from Natwest today offering full settlement of £980 saying, 'packaged account fees, stopped cheque fees, interest & charges refunds have been excluded from this figure'.
    I have checked my figures and have included, no more than £100 of charges for simply having a certain type of account. I now realise that these charges are valid.
    I am worried that if I refuse their offer, when I get to court, focus will be put on the fact that part of my claim is invalid and therefore my whole claim is?
    Any recommendations?

    Hi, I've just started the claims process by sending off the dpa letter and £10 cheque to NatWest. They responded a day later with a letter acknowledging receipt of payment and agreeing to send out copies of my statements.

    Today, about a week later, I have received copies of statements from June 2001 to October 2002. It's a start I suppose but conveniently for NatWest it's a period with no charges.

    Has anyone else experienced this and did they send out the rest of the statements in sections?

    Also could someone please tell me the number to ring to speak to NatWest about this?
