    I spoke to Northampton court today regarding the defence of my claim which had been transferred to my local county court. The letter that was sent to me had the part mentioning the allocation questionnaire crossed out so i rang them to inquire. I was told by the lady that because most banks are not paying out without going to court, the judges have decided not to send out allocation questionnaires immediately and wait which is good news i guess.

    Anyhow i'm sending off the required documents to Natwest's solicitors today.

    I'll be sending of this letter which i got from Pa, in their request for CPR Part 18. A copy of which i'll also send to the local county court.

    I acknowledge receipt of the defence posted on behalf of National Westminster Bank plc, in your letter dated xx May 2007.
    I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative.
    I am somewhat surprised that you have requested the information outlined in 2.1 of the ‘Request for further information and clarification’, since this information – in the form of a Microsoft Excel spreadsheet - was sent to National Westminster Bank PLC on xx March by recorded / ‘signed for’ delivery, and I have proof that this letter was signed for. Additionally, this same information was sent to MCOL on xx April, with the request that it be attached to the particulars of my claim. It does somewhat concern me that you are dealing with this matter without having all the paperwork from your client, National Westminster Bank PLC.However, for clarity, I enclose a copy of the above mentioned spreadsheet, and confirm the charges I am claiming were applied to the following account:

    Along with that is there anything else i need to know and more information i need to add?

    Oh and along with that i'll be sending the spreadsheet of charges. Should i send the orignal one, or the new revised one with the interest charges on it which is the one i filed with MCOL i think
  • Hey here is my situation


    I have sent the first letter off to natwest with a £20 cheque for 2 accounts I am claiming for.

    I have not heard from Natwest for 40 days so I sent another letter saying that I want my charges and statement within the next 5 days and still I have not heard anything.

    I have also just found out that they have not taken the £20 out of my account for the statements and charges.



    What should I do next?
    Mint Credit Card £3900
    Should all be paid off by Feb 08

    Proud to be dealing with my debts

    First type of charge appears each time a direct debit, standing order or cheque you have issued is returned unpaid as you have broken your agreement to have sufficient cleared funds available.This is a penalty so reclaim it.

    Interest is the agreed monthly interest charged on the account overdraft so not reclaimable.

    The second charges amount is for exceeding the agreed overdraft limit between 6th Jan and 5th Feb this should only appear once in any month it is a penalty for breaking the contract so reclaim it.

    I haven't had £9.00 pr £20.00 charges but suspect these apply to a different type of current/card account if they have not been agreed as administrative fees *see Terms and Conditions then you may be able to reclaim them.

    Thanks for the very clear explanation it was very helpful. I started off with an advantage gold account with natwest and it is on these statements where it says unarranged borrowing £14.00 7Jan - 28 Feb I take it the charge just must have increased over the years to double the amount.
    I think the £9.00 must have been what they call the service fee which also increased from £6.00 to £9.00. I dont think I can claim this back though?
    Iam already up to £3775.00 and I have not put any interest on yet.

    I had my offer letter on 7th June and returned it on 8th June, I phoned yesterday and today to find out when my money would appear in my account only to be told my letter wasn't logged on the system and from when it gets logged it could take up to 14 days. I asked the girl today for a fax number as i said i was worried it might have got lost in the post as foolishly i didn't send it registered. I faxed it to 0131 523 6933 at 13.45 today and the money has just appeared in my account. Amazing!!

    I have a Natwest overdraft of £2,500 - I have never gone over this amount but am regularly £1,000 to £2,000 overdrawn and get charged between £20 to £30 a month for the last few years.

    Am I able to claim it back or not? If so, how much can I hopefully expect back? Half?

    Yes you can claim it back. And I wouldn't settle the bar for too low - why don't you go for everything?

    Wow - thanks Beate - are you sure though?!!! I was under the impression that it was only the extreme charges when customers are severely charged after going over their overdraft limit?

    Maybe you should read Martin's article again then. No bank has ever said how much it actually costs them. The OFT recommendation of £12 has no legal background either. Be bold and claim the whole amount.

    You cannot reclaim interest on the money you owe, it looks like that’s what it is. If you owe £ 2000 at 12% interest, that will work out as about 20 quid a month. Nobody will lend you money for nothing. Even banks must make a living somehow. :D

    (Penalty) charges are added when you exceed your overdraft, have bounced cheques or DD. That does not seem to be the case in your situation. Get your overdraft down, then you will pay less interest.
