    Hi, thought I would put this here. I started a new thread a few days ago about my situation, to ask some questions, but this is more of a progress report :)

    On the 8th May I sent a letter to Natwest, using an slightly altered version of the template on this site, to ask for both my Current accounbt and CC charges. I sent the £10 cheque, which was banked.

    I received my current account statements, but had not had my CC ones. I sent a further letter, which said

    I sent a letter to you on the 8th May, requesting both my Current Account and Credit Card charges.
    I received the Current Account statements on the 23rd of May, but have not had the Credit Card charges as of yet.
    I am to inform you that the 40 days you have to respond started when the first letter was mailed, and that you have until the 17th June to reply with my Credit Card charges.

    If you are unable to provide this data, I will accept a copy of my Credit Card statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.

    If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

    I look forward to your response by the 17th June, as Natwest is obliged to reply under the Data Protection Act. If not I shall seek remedy from the Information Commissioner.
    I got a letter for them today, which you can see below (click it for a bigger version):

    Notice, it says to send them £5. If £5 is the cost, and I sent them £10, then they have had the money already.

    I found, via this forum, an email address for someone at Natwest which has been helpful in the past, and sent her this email:
    Hello.
    I am writing to you in the hopes that my case can be moved on a little swifter than by standard mail, as the 40-day deadline is looming (17th June).
    This is the letter I typed out. Please find the letters referenced in the first letter, below it.

    I hope you can help me with this.

    So 6 more days, and then it's on to the IC *sigh* :(
  • Im currently reclaiming charges from Nat West bank, sent off for statements and received them back in one week.

    Thought this was a good start and worked out all charges, however once I started entering the charges on the interest calculator with dates etc I noticed that something was amiss.

    Nat West had actually duplicated some of the statements so that they would run, Jan, Feb, March, April and then back to March and then start again for May etc.

    This happened on 7 different occasions for my statements for 2001 and 2002.

    Could this be an honest mistake by the bank or were they trying to see if I would check my claim thouroughly and maybe trick me into trying to claim more than I am entitled to?

    If I had gone to court and then this error was discovered would this have worked in Nat Wests favour?

    Maybe Im reading too much into this but has anyone experienced this error or have any views on this subject?

    I received some documentation from Cobbetts requesting some information from myself which needs to be with them by the 15th of this month. Do I need to send them anything?

    Also, I have received no other documentation from any courts etc. Can anyone please shed any light on what I need to do now?

    Hmmm, probably just a basic error in all honesty! I was sent FOUR sets of statements for the 6 yr period - they kept coming through the post and it was so annoying after the 2nd time! I think that the Customer Relations Unit is snowed under with requests for statements etc. and it is inevitable that mistakes will occur. Anyway, it's not important. All that matters is that you don't make any mistakes when you are adding up all your charges and entering them in the charge calculator! You don't want to give them any reason to delay or reject your claim! Good luck.

    wheresitallgone , I had the same with my statements from Natwest. It as like some months were duplicated at random.

    Either it is a mistake affecting everybody or a cunning trick! Just goes to show that you should pay attention when putting your claim together...

    It all depends what information they have requested from you - read through this thread for more information on what might be needed.

    Hi everyone,

    when I was at uni 1999-2002 i was quite irresponsible with my natwest account and had a heck of a lot of charges for unpaid cheques, direct debits etc. I wrote a letter to Natwest on April 18 2007 requesting my statements for the last six years, I knew that I would be only able to claim from april 2001-april 2007, but I was sure that at the end of may and June 2001 I had about £300 of charges for a number of things. Natwest have been stalling in sending me my statements, on the 35 day after I sent my request I received a letter from Natwest, signed by Joyce Tudor, which said that I needed to include a £5 fee for this service, I had already icluded a £10 postal order with my original letter, and also I was asking for statements from another account so £10 would cover both accounts. She said the 40 day period would not start until they had the correct info. Very frustrated I sent a reply stating I had already given all the info they required and that if I had not received the statements within another ten days I would report them to the information commisioner, 20 days later I am still waiting for any further correspondence. Please can anyone advise me what to do next and secondly does anyone know from what point I can reclaim my charges, six years from the day I sent my initial letter requesting my statements, which would bring it back to April 18 2001 or when Natwest finally send me my statements would it be from the point when I make my official request to reclaim the charges. If it is the latter it means I have missed over £300 in charges which I could have definitely claimed if Natwest had got their finger out, so to speak, and sent me my statements within the 40 day period. Any help on these matters would be gratefully appreciated. Many thanks, Matt.
  • Hi ya,

    well i gave natwest their 56days and an offer was made on the 49th day i received the offer letter on the 56th day for the full amount minus interest and it has now been signed sent back and im now just waiting for it to be credited to my account it should be thereby thurs/ fri this week.

    Its a lot less hassle than some other routes, plus it only cost me the price of a 1st class stamp. Good luck

    Its a standard letter they say they have 8 weeks to respond. However stick to your timescales not theirs!

    They finally paid up for me on my claim after 10 weeks couldnt afford to take it to court using MCOL so had to wait it out however i did send the letters using the timescales on here.

    My money finally arrived into my account today. Thought I'd post as I always found each report of another victory kept my spirits up regarding the day when finally I would get back what had been wrongly taken from me.


    I waited for the 8 weeks rather than taking them to court. Sticking to the timescales regarding sending the first two letters. Before ringing up and being made a verbal offer at the point I was going to start court action. At the end I was ringing up regular to check the progress and the people dealing with this, whilst very nice and helpful, are snowed under, inconsistent in what they think they should/can tell you. Some will tell your offer before the letter reaches you others won't etc. Last time I rank up, I was told that my offer letter wouldn't reach me till after the 8 weeks was up and they couldn't give me an exact date it would be printed. It then arrived the next day dated 5 days previous.


    Stick in there people, good luck to you all.
