They have 40 days from when you sent the request to send you the information required. It won't matter who wrote the cheque and they may well end it back and that might be why it hasn't been cashed.0 -

a 14 day letter is a 14 day letter is a 14 day letter. you have given them a deadline which is a reasonable one .
they seem to have sent an awful lot of the same standard letter out on the same day. fortunatatly they had my letter longer than 14 days before they bothered with the holding letter . so off to court i go. :rotfl::j0 -

Just had a letter from natwest saying the charges are correct and no offer of a refund , it took them nearly a month to reply so its off to court with them

I know its a little off the wall - but what if you work for the bank you're trying to claim over £1000 back in charges on 3 different accounts since 2002? Too risky???
Dont see why I should be treated any differently, I work just as hard for my dough!0 -

Maddening, isn't it?
By the time the 13th day arrives, You'll notice that you can't go any furthur with your online claim ( .. just when you thought you were going to win by default, as the NW haven't sent in their defence to you yet)
You'll probably get their defence ( .. from Cobbetts) sent to you just after the 14th day, then you'll have to wait for the court to send you an AQ ( .. allocation questionaire).
After that, you'll get a date for the trial; which you'll not have to attend as the NW will have paid up by then.

hi ya all. Long time lurker, so apoligies for questions in my first post.
I've calculated NW owing me £931 in bank charges. HOWEVER two questions remain unanswered for me ;
1. Intially I had a large overdraft on my account - this after 2 years was reduced down to £100 but each month intially I was charged almost £15-£20 interest. Is this claimable or not ??
2. This probably doesn't matter, but sometimes the date of the charge is different from when it was debited from my account. Does it matter what date I put down on my list I'm sending to the bank ??
Any advice gratefully appreciated.

i'm doing this at the moment with natwest. got statements through yesterday, 2nd letter's going out tomorrow. i'll keep you posted.0 -
1. No. Sounds like normal overdraft interest, albeit pretty hefty.
2. This may be because one date is for the 'offence' and one date for the charge taken from your account. Put the date it was taken.
NW are still making me sweat it out. Sent AQ back over a week ago and replied to Cobbetts telling them I thought they were intimidating me, but included another schedule of charges.

Hi, I am about to send my 2nd letter (7 day one) and am using the template on here. However, does anyone know what to put in the space for
"This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour. "
Also in the first paragraph of the letter, do you put the amount in with interest, as i sent the first letter with interest....
"I refer to default charges applied to my account amounting to £2137.13, which I have requested you pay back. "
or is it the amount of charges.
Any help would be much appreciated.
