Your claim sounds much like mine. I phoned initially after a few weeks of first letter (second was already sent). They had recorded it and said they would respond within 8 weeks of receipt date. They did, bang on the 8 weeks with an offer. I refused offer since I also wanted to include my business account and a few hundered further charges since. I phoned a second time to request that someone discuss the claim with me and they called back yesterday. They will not pay the interest if not thru' court but will pay every penny of charges if they are relating to overdraft and bounced payments. They were also very pleasant. A revised offer is being sent which I have already verbally accepted. It's worth a call on 0845 30 30 456 to speed up your claim. Good luck!

Am I happy? That will be right!!

Facts: Money for many years has been stolen from my account.
Interest has been charged on the lack of money in my account.
The theives are well known and guilty.
All they have to do is put it back if taken in the last 6 years.
No punishment. No Compensation. No Charges.

Well Hey!! Honour among theives and all that Jazz....the government ought to be ashamed of the way they have avoided this issue and allowed this corporate theft to go on unpunished.
P.S. I was advised that if I'd said I wanted all other charges up to date of settlement included I should have said so in my letter. Duh! Silly me, but isn't that stating the obvious? Might be worth adding a short paragraph into Martin's example.

Congrats to you Moon river Your case illustrates the inconsistencies re staff / nat west and negotiating
I started my claim in Feb ,got the statements promptly but no other response -zilch in 3 months Went through all the templates and deadlines Silence until they acknowledged the claim and intention to defend Tried an email froman address on this thread. It took them 10 days to say nothing eg 'we have passed on your email to the appt dept!!
Telephoned the numbers given and usually left on hold /engaged - 28 mins on one occasion
Then last week after months of frustrating silence -2 letters in one day 1) the defence from Cobetts 2) an offer
I phoned this week to try and negotiate and was told Nat West Policy is not allowed to negotiaite at this stage. Either accept offer or go to Court. Polite but firm Non Negotiable
Reading through the site their are many variations on how they proceed and conduct themselves The most certain seems to be that they do pay up in the end

hi i dont know if overdrawn charges are an unarranged borrowing fee or a service charge
  • Requested statements Feb 22, - arrived in torn bag 4 weeks later.
First letter sent March 23 claiming £1000 + £200 interest.
    No response.
    Second letter sent April 17
    No response
Filed MCOL May 10, for Natwest to receive May 15th
Received letter from Natwest May 25th, (second class post!) with usual standard verbage offering £1000. Decided not to accept.
Just as soon as 14 days were up this morning I requested and was accepted for judgement by default on MCOL. But later on I checked again and Natwest had acknowledged claim!
Called MCOL customer service. They explained MCOL is not an instant on line service but can have several hours delay. Natwest acknowledged on last day, possibly by post, but it wasnt put on site until after my judgement. So now have another 14 days to wait to see if they will defend or settle.
From other posts it seems there is no point in negotiating at this point. Lets see what happens!

Have received letter back from Natwest stating they are 'currently considering my claim', 'we will be in a position to respond within 6-7 weeks'. This was received after the 'Threaten to take it to court letter' from Martin's website was sent; Natwest ignored the initial request.

Has anyone else received this response?

If so did you reply asking the claim to be dealt with in a more timely fashion?

Are they bound by any law to deal with the claim within a certain time frame?

Or do i just have to sit back and wait?

    Many thanks in anticipation
Yep had same letter i e mailed them with complain as well e mail back within 3days received offer week later after same letter

The multiples of £30 up to £90 for being overdrawn every month are also claimable.
Natwest invariably add the £28 charge to the account fee (in my case £12 for Advantage Gold Account) and it can be overlooked. They went thru' my claim and deducted all the £12's.
Can anyone answer this....in Scots Law I was under the impression that since I complained 3 years ago about charges and was refused a full refund, I had actually instigated my claim then and not this year (2007). Therefore I can go back 9 years. Any comments?

Hi i have a Natwest Current Account, with a overdraft of 800, which is up to the limit by the end of each month.
Will the bank make me pay off this overdraft before they will pay out the charges they will owe me.
My salary goes into the bank at the end of each month.
I cannot afford to pay back this amount untill i have received the money they owe me.
I also have all my direct debits going out of this account.
I need this overdraft each month to live off unfortunately.
    PLEASE HELP!
If i am successful in claiming back these charges,it will enable me to get out of this mess.

I have just had success in reclaiming the charges the money went into my account yesterday and the overdraft limit is still the same as it was before i claimed having said that you really need to set up a parachute bank account just in case the natwest get nastey i found the alliance a leicester to be very helpful on the phone they set up an account without any problem including a £500 over draft

    good luck in your claim
Received £4541 reclaimed from Natwest :j:T

    Hi Jonun & Timewill Tell

Thanks for the good wishes but unfortunately they havent worked! - Heres an update for you:

Well ive just been catching up on everyones story and i see non of us have had an good news since ive been away!

Cant believe they have told you not to ring again thats disgusting

I got back yesterday and found nothing in the post - couldnt believe it after i have been told that i should have received my letter a couple of days after i had gone on holiday!

I rang yesterday so angry and got told my letter was sent on the 24th May! I explained its not arrived yet and its 10 WEEKS since my claim - all i got was fobbed off again saying well with the wknd and bank holiday it should be with me anytime now!

If ive not got it when i get home today theres gonna be trouble! I dont want to file with MCOL today as its just my luck i will and my letter will be there so i will loose my money to file.

I might try and ring that Elliot Porte man this morning see what he has to say and im going to ring the FO again to let them know whats happening.

I do hope my offer letter is for more than my original claim as i do hope now they have added on the further charges i have claimed after all this messing around.

Im so annoyed and have only been back a day - so much for returning to some good news eh!

Hope you two have better luck than me! xx
