    Hi im claiming £3,317 including interest from natwest claim started march 31st they have ignored 2nd/3rd letters so i phoned them they said my claim had been validated and i should receive offer of £2,807 by the 6th june this is the time theyre allowed so they say since claiming they have charged £28 for being £1.05 overdrawn when i queried this was told to ring again on option 2 i did this was told i couldnot claim ever again on account as my claim is going through does anyone know about this is it true and should i accept offer please advise A NAIVE CONFUSED NEWBIE by the way if anyone needs to know PHONE NO FOR NATWEST 0800 015 4212 OPTION 1

    If your offer is the full offer, without any interest which it sounds like, you must accept this and probably with your offer will be a letter saying that you won't be able to claim again and sign here please. You really need to wait to see what the letter says.

    You can of course score out the bit about not claiming again before you sign it and ask if they will add on this recent charge.

    Ah ha! It's not scored out, it says that Judge Murdoch in N/hamton 'without hearing' has ..."ordered that the filing of an AQ be dispensed with in this case unless the District Judge at the court of transfer orders otherwise". Then in small print "Please note that an allocation fee maybe payable in this instance". So I just wait for my court date, turn up, wait for RBS to not turn up, have a chat to the judge, and wait for my money?! Thanks for your help, again. Maybe when this is all over, we should start a campaign on how straightforward the Great British legal system is....not!

    fingers crossed for smudgemanc26 return from hols to good news. i have jus under 2 weeks for there letter of offer, (or so they say)

    well dont know if you read the other day so il let you know briefly..
    got a letter from FO telling me that they have wrote to natwest re my claim and i should have an offer before the 56th day, if not to let FO know..dont know what FO said to natwest..
    ive been ringing almost everyday and yesterday i had a missed call and a voice msg, it was customer relations telling me to stop ringing..he said ive spoke to a few of my colleauges and it appears you rang friday, monday and tuesday!!! how dare they?? he didnt leave his name but ive kept the msg!!
    i think they are narked with me cos FO told them off!! hahahah>>
    anyway i rang ELLIOTT PORTE..who kindly rang natwest on my behalf and he rang me back to let me know what they said..my offer was being validated and i will have an offer within 2 weeks!!!
    i take it you have had no news???

    I had been messed about by Natwest since March and had received 2 letters saying that they were investigating my claim and made several phone calls etc.

    Finally emailed Michael Duncan (Royal Bank of Scotland CEO's right hand man) and within 7 days of receiving the response from his office saying they were looking into it for me I had an offer from Natwest for the full amount.

    Apparently Elliot Porte is in the department that actually make the offers and he the letter that I received told me that if I wished to discuss the offer I should call him.

    I did call him, but only really to say that I thought there letter was funny how they babbled on about not being in the wrong and being perfectly secure in the knowledge that they had done nothing wrong and he even stated on the phone that he thought the bank would win in court. I said it doesn't really matter seeing as you have shown your cowardess by paying up instead of joining me in court if they were so confident. I just wanted to gloat a bit really.

    Anyway thats one down....several to go...Thankss to all the help and advice on this site so far...

    Hi all, My first post and think i need some advice!!

    I sent my first letter to natwest on 10th april with £5.00 Postal order, received statements back within 16 days!

    The sent letter back to them on 28th April asking for 929.+ interest =£989.38 and have not received a reply!!

    I sent another letter off yesterday asking for £750 in final settlement as need money desperately.

    Have I done the right thing?? any more pointers???
    Natwest Owed Me - £989.38 inc. Interest - they paid me £929.00!!!!

    Nationwide acc't 1 - £849.24 W/O Int. £1412.08 inc.
    Nationwide acc't 2 - £374.14 W/O Int.

    It is very over due but I thought I would tell you about events after Fat West payed up.

    A few days after I got the letter from Cobblers saying " charges are fair.. blah de blah.. heres your money, interest and court costs" but also " on the strict condition you withdraw the case and that you sign a gagging clause".

    I then got an order from the court, although it was more relevant to Cobblers, I think it might offer others some hope.

    The Judge ( who I wish I had met, so I could thank him) ordered that;

    The part 18 request is struck out as an abuse of process and that the defendant file and serve a comprehensive witness statment from a responsable employee with a statement of truth explaining the banks charging regime and all relevant documents justifying it; and if they are discretionary, the decision to apply the charges the subject of this claim to the claimant.

    I almost wish it had gone to court.

    Strengthened by the Judges common sense aproach, I banked the cheque, notified the court of the settlement but wrote to Cobblers stating that I was not prepared to accept the gagging clause, although I am not as learned in this area as they, I understood that such a clause may be a breach of my human rights and furthermore, I struggled to understand why; if, as they said their client was confident my case would fail in court; they chose to employ intimidation tactics as a defence.

    I went on to say that should they not be content with my response I would of course return the money and we could let the judge decide.I copied the court into my response.

    Funny, I have not heard a thing.

    I think the Judiciary are getting fed up. I was very worried about it all, had I got it right, would I be the one to go to court and loose. Although it took a long while I cannot beleive how easy it was.

    I am now telling all my friends and family to do the same.

    my wifes niece has just got the full 800 quid claimed, (nat west) after just one letter!
    what a result eh?

    3 members of the family have now succesfully claimed off various banks.
    Get some gorm.

  • hi jonun, it must be the new tactic with them, telling people not to keep ringing, as they told me on monday i can,t keep ringing and i have only been ringing once or twice a week. if they told the truth to people in the first place and got letters out when they said they would, tthen we wouldn't have to keep ringing, and who do they think they are dictating to us that we can't keep ringing. well they were fast enough in ringing me constantly when i went over my overdraft. like i said to the snotty women, it is my right to telephone when i want.
