My business account was closed two years ago but I still managed to get the copies. Because my original letter (sent recorded) was ignored I went into the bank and complained. They apologised and orderd the statements by fax without a charge - they arrived within days!
I hand delivered the letter requesting my fees yesterday and shall hound the branch until I get a reply.0 -

You might get a blank stare from the teller!
You have to make the request in writing and you have to do it in a certain way. You can't just ask for 3 years worth of statements.

Hi Ripski - I'm in much the same place as yourself. Natwest filed a defence, and a couple of days later I received a copy of their defence plus a questionnaire to complete (CPR Part 18 request). I must admit it's left me sweating, wondering if I'm the one who'll have to defend myself against them in Court
I sometimes wish I'd never started this, and that they'd replied to my letters with an offer to refund charges before I took out the MCOL claim. I wish I'd gone down the FO route instead.

Hi - thanks for replying.
Yes, when I wrote back to Cobbetts, I pointed out to them that I anticipated that my claim would go down the small claims track, therefore their CPR18 request wasn't applicable and that I wasn't prepared to respond to it unless the court or a judge specifically asked me to do so. I hope it shuts them up, and that Natwest cough up

Cobbetts have a propensity for templated defences (presumably they think if we can do it then so can they
) especially Ms Burgoyne.
They are also fond of making interrogatory statements (questions to you or I) that should wait until the hearing. They do like to attempt to intimidate the average lay person.Hamsters have no tact and diplomacy, nor do they want any.0 -

They certainly do - I said that I considered the CPR18 to be intimidatory and intended to bring it to the attention of the Courts

Nothing for you to do at the mo They have 14days until the 9th June to 'acknowledge' ( which Nat West did re mine) Then they have a further 14 days to lodge their defence ie Altogether 28 days If they have not filed a defence on the 28 th day at midnight you can press the 'judgement 'button as they will have lost by defualt So you could press the button at one minute past midnight on 22 nd June. But it might be the Monday as the 9th is a Sat Best of luck BUT Nat West filed their defence at 2.0pm onthelast day I am hoping this is just another delaying tactic as now I have twait foracourt date which could take months before , I hope ,that they settle .0 -

Please help. I have been through the whole process as described on this website and have just paid £120 to take Nat West to court. The only reply I have had throughout from Nat west was to acknowledge that I had sent a letter and that they were looking into my claim. This was a day before the 14 day deadline was up before I took it to court and I just took this as trying to stall the process so I went ahead and paid my £120 to go to court.
What happens next, I believe there is a form I need to fill in or something but i'm not sure
My total claim now is £1,6800 -
I think you are a long way from being at court yet. Read through this Natwest thread and you'll find lots of people in similar positions.
You need to wait now until you hear from the bank/solicitor or the court and then you send them whatever information they ask for.
