    I gave them 14 days to reply as suggested in the original letter which has already expired but they have then obviously come back with this latest reply.

    So should I now send another letter threatening to take them to court?

    Did Natwest reply to anyone else saying it would take them 6/7 weeks to look into it? If so what did they do?

    simple answer is yes to both questions ie send the letter threatening court action (as i am assuming that you gave them fourteen days in your first letter) and yes they often state that the fsa say they have 8 wks in which to deal with complaints but its your timetable now

    Hi all

    Began process of claiming for 3 accounts with the Natwest at the end of March. Being too busy at the time for MCOL i decided to give them their 8 weeks. One account was validated for an amount of nearly £2500 after just a couple of days.Another account account was validated for just over £1000 again within days.
    Apparently offer letters are due to go out to me in due course for the full amount i am claiming less interest. Result!! Or so i thought.:j
    The lady I spoke to was very helpful and said to wait for the letters and once i had accepted, the money would be in my account within 10 working days. I also spoke about having recent charges refunded as well, and was told that i would have to speak to another department as this would be treated as a new claim.. OK i said and got put through to another department.... and then another.... and then another....:mad:
    Anyway finally got to speak to someone who told me that while my account is overdrawn, these charges would continue to be made against my account. Best advice she gave was to call back when my money goes into the account was to make a claim then. Fair enough I suppose......
    Anyway, she said that she would try and chase up duplicates for me, but they could take up to 8 weeks.... And if they didn't come through to ring back then and request duplicates which would take up to another 8 weeks:mad: :mad:
    I explained to her that i had another claim with them for about £800 which had not been validated yet and that if I didn't get my letters soon then i would be taking the matter to court which of course would award the interest etc.. and cost them more.

    So, their 8 weeks is up at the end of next week for all 3 accounts, and bundled together with the new charges is a few pence short of £5000.

    Has anyone else had this experience with them... if so what happened ?
    Also, anybody got any ideas of what to do regarding the court process. If i was to lodge my claim with MCOL next week how long will it take to get to court and get my money back as a general rule of thumb. Or should i start the claim now...?

  • Please dont forget that if you cannot afford you court fees because you are on a low income or if you are on benefits you can fill in a form call an EX160A fee exempt/Fee remision form. If granted, this will stop you paying the court fee for the action you want to take. Please note that each time a fee is payable a new EX160A must be completed. This applies to all court fee including AQ fees and warrant fees

    I can only give my experience of Nat West which has been total non response and to be ignored . I have adhered to Martin's templates and guidance re timetables Nat West initially sent my statements promptly then nothing I have tried tel the numbers quoted on this site to no avail Eithe rput on hold or engaged for 20 mins plus andI have given up . E mail was no better either . I started my MCOl claim in April and if you have the money then I would advise this. Nat West acknowlwedged this but thereafter nothing - No settlement offer either. They said that they intended to defend and I now have 24 hrs left before pressing the " Judgment button" I am feeling vulnerable and jittery and I expect that they will submit there defense tomorrow However I have nothing to lose and am ploughing on as per Martin advice I am worried thtaI am the one who will get nothing or have to defend .
    One thing that has become apparent form trawling this site There is no formula or standard response from the banks. Each bank is different and the banks are different with different individuals The right hand not knowing what the left is doing.

    I issued at Court and it was deemed served on Bank as of Monday.

    Basically, the Bank verbally told me some time ago that they had a note on the file to pay all the charges following my initial letter to them, but after 56 days unsurprisingly they didn't send me anything. I obviously completed the POC and issued, but now I'm wondering whether I should have put in the POC the fact that I spoke to them and they made a verbal offer? I have name and number of who I spoke to. To me this is surely an acknowledgment by them that the charges aren't right, otherwise why would they refund them?

    Wondered if I could/should amend the POC or bring this up when/if they defend the action?

    Any thoughts anyone.............................:rolleyes:

    After receiving all my statements and adding up the damage caused by Natwest, I sent my first refund request letter on 18th March 2007.

    No response to that, so sent the second refund request letter on 3rd April 2007.

    No response to that either, so on the 2nd May 2007 I filed with MCOL.

    My claim was £2182.00 plus interest of £130.68 and £120.00 court fee, £2433.53 total.

    Natwest were served with my intended proceedings on the 8th May, and they had until today (22nd May 2007) to respond. They acknowledged my claim today by the way!!:rotfl:

    HOWEVER, last Monday I received an offer letter from them for £2260.00, which I promptly accepted and sent off my acceptance form!!
    I thought I would have to wait forever, but I checked my online banking tonight to see if I needed to transfer any money to cover direct debits......
    and my money is in already!! It went in yesterday!!!! :j :j :j

    I know I could probably have held off and got every last penny, but to be totally honest I really need this cash NOW not in two or three months time when it goes to court!! When you add it all up it is almost two months wages for me, and its been a struggle to stay affloat without it!! :confused:

    A success story for me, I feel great and I am sure I will sleep like a baby tonight instead of rolling pound signs in my head all night!!:beer:

    I actually phoned them on that number, I did'nt give them a deadline, that was the date confirmed by them after the 8 weeks would be up.
    As they confirmed the amount they would be offering me over the phone I decided not send them a letter threatening court action (yet!!).
    I know i've strayed from the timetable but if they are willing to refund my full claim as they said they will I don't want to jepordise the situation.
    As in a reply by Kurt Hamster in an earlier thread advises, why go to court if they are prepared to pay?

    After finally receiving my statements - took 42 days - I handed my letter requesting my bank charges refund, into my branch yesterday. The owman (well, young girl) was very dismissive of me and made a point of opening the letter to read it. She commented that I'd be lucky to get all these charges as they were 'standard charges' and that my letter was wrong as it takes 56 days not 14. I pointed out that my eltter was correct and that I probably knew more about what I could claim than she did as I took my information from an expert in the matter. She got sniffy and said, 'well its still 56 days!' I just walked away. I closed the account some time ago so they can't 'so anything' to me. I shall keep the pressure up just like they did when I was overdrawn through no fault of my own and the Natwest made me very ill and upset because of my money failures. For once I could walk into their branch with my head held high.
    They owe me over £1,000 which will go a long way to clearing my debts.

    I had been messed about by Natwest since March and had received 2 letters saying that they were investigating my claim and made several phone calls etc.

    Finally emailed Michael Duncan (Royal Bank of Scotland CEO's right hand man) and within 7 days of receiving the response from his office saying they were looking into it for me I had an offer from Natwest for the full amount.

    Apparently Elliot Porte is in the department that actually make the offers and he the letter that I received told me that if I wished to discuss the offer I should call him.

    I did call him, but only really to say that I thought there letter was funny how they babbled on about not being in the wrong and being perfectly secure in the knowledge that they had done nothing wrong and he even stated on the phone that he thought the bank would win in court. I said it doesn't really matter seeing as you have shown your cowardess by paying up instead of joining me in court if they were so confident. I just wanted to gloat a bit really.

    Anyway thats one down....several to go...Thankss to all the help and advice on this site so far...

    Thanks so much for this post, i have just phoned and spoken to Mr Elliot Porte himself and he said that he is going to get on to my case for me and chase it up and see whats happening with it, whether or not he actually does anything to help is another matter, but as its coming from the CEO's office it might help.

    All i can say is everyone get on this mans case the sooner the better he may help sort out the shame they call customer relations, its worth a goi'll let you know what happens
