  • I wonder if anyone can help me.

    I'm claiming 4574.00 from Natwest.
    I've followed all the proper procedures , letters as recommended, to all the timescales etc.

    I entered a claim via MCOL on Friday and it was issued on Monday.On the MCOL website when i log in it states the claim has been issued, and under the judgement section gives the option to 'continue', then 'i accept the defendant's proposal for payment' or ' the defendant has not made any proposal for payment'

    I'm not too sure what i have to do now!!???!!! I assume these options are for use after the 14/28 days are up??

    The court letter (notice of issue) i received today states that Natwest have until 9th June to reply.


    Do i have to do anything between now and then???
    I don't want to mess up the whole thing by doing something i shouldnt or not doing something i should have!

    Any advice would be appreciated!
  • Thanks so much for this post, i have just phoned and spoken to Mr Elliot Porte himself and he said that he is going to get on to my case for me and chase it up and see whats happening with it, whether or not he actually does anything to help is another matter, but as its coming from the CEO's office it might help.

    All i can say is everyone get on this mans case the sooner the better he may help sort out the shame they call customer relations, its worth a goi'll let you know what happens

    Wow i cant believe it Mr Elliot Porte has just called me to say that my claim is in the system and i should be hearing from them within the next week, i just cant believe that Fatwest have actually gone out of their way to contact me,all i need to do now is wait and see if anything nice appears in the post from them.
  • Can anyone help me!!!!??? I am in the final stages of court action against natwest bank to reclaim my charges. They made me an initial offer of £1,500 pounds, but i continued with the claim because they owe me near to £2000. they have sent a defence through from cobbetts solicitors asking for the charge/interest schedule. they also want me to explain how the unfair terms in consumer contracts regulations relates to the claim. they have basically called my bluff. what do i do?
  • I wasnt 100% sure on claiming back my charges with Natwest thought I knew about needing 6 years of statements to be able to find out what I was entitled to. Therefore I went into the bank and asked them if I could have this information. Since the account was closed a long time ago they said that it was impossible for them to do but I could fill out a form for them to send away for it to be processed.
    So my first question is: Do you think I will ever actually get the statements or do I HAVE to send away with a cheque?
    And my second question is: Because the account will be over 6 years old, is it 6 years worth of charges from the date i send the letter asking for the money back?

Therefore I went into the bank and asked them if I could have this information. Since the account was closed a long time ago they said that it was impossible for them to do but I could fill out a form for them to send away for it to be processed.

    Banks are only obliged to keep records for 6 years, most keep them for longer though.

    I'm not sure if "Because the account will be over 6 years old" means it was closed 6 years ago or it was opened 6 years ago. If it's the former then you are going to have to use the concealment/Limitation Act gambit to claim anything. If it's the latter then there's no problem claiming.

  • sorry what I meant was the account was opened about 8 years ago, and closed about 3 years ago, so I gather that I will only be able to claim for 3 years (6 years back from present date). What do you think about me going into the branch and asking for statements that way? Do you think I will ever get a reply? Thanks again

    After receiving all my statements and adding up the damage caused by Natwest, I sent my first refund request letter on 18th March 2007.

    No response to that, so sent the second refund request letter on 3rd April 2007.

    No response to that either, so on the 2nd May 2007 I filed with MCOL.

    My claim was £2182.00 plus interest of £130.68 and £120.00 court fee, £2433.53 total.

    Natwest were served with my intended proceedings on the 8th May, and they had until today (22nd May 2007) to respond. They acknowledged my claim today by the way!!:rotfl:

    HOWEVER, last Monday I received an offer letter from them for £2260.00, which I promptly accepted and sent off my acceptance form!!
    I thought I would have to wait forever, but I checked my online banking tonight to see if I needed to transfer any money to cover direct debits......
    and my money is in already!! It went in yesterday!!!! :j :j :j

    I know I could probably have held off and got every last penny, but to be totally honest I really need this cash NOW not in two or three months time when it goes to court!! When you add it all up it is almost two months wages for me, and its been a struggle to stay affloat without it!! :confused:

    A success story for me, I feel great and I am sure I will sleep like a baby tonight instead of rolling pound signs in my head all night!!:beer:

    Keep at it guys, It really will happen for you too!!

    Congrats You lucky thing and all the best. Nat West have ignored all my letters.They did acknowledge MCOL claim and had until midnight tonight to file their defence. At 2.0pm today -no defense I was poised to press the button tonight At 3.00 pm a defence showed up !!! More puzzling that it said the defence was filed 20 /04/07. I am very puzzled by this as my MCOL claim was not even started on this date. Obviously going to hold out until the last and make me sweat. They are succeeding
    Any advice please

    Hi Ripski - I'm in much the same place as yourself. Natwest filed a defence, and a couple of days later I received a copy of their defence plus a questionnaire to complete (CPR Part 18 request). I must admit it's left me sweating, wondering if I'm the one who'll have to defend myself against them in Court :( I sometimes wish I'd never started this, and that they'd replied to my letters with an offer to refund charges before I took out the MCOL claim. I wish I'd gone down the FO route instead.

    Hey pam. Don't lose sight of your goal. And don't forget it's Natwest on the defense not you. The very worst case scenario is you'd not get paid out. But why would that happen when they've paid everyone so far? I got an offer yesterday which I'm taking, lot's of Natwest customers have been successful so stay positive.
