OK i have a question for you all, i currently have a claim being looked into by Natwest for just over 3k, can i also claim back for my loan as i had to take this out to cover my bank charges that they had applied to my account as they told me i had no other choice and giving me a loan was all they could do to help,in oct 04 they put a total off nearly £800 of charges on to my account and i couldnt pay them back they told me i have no other choice but to take the loan and i had to have it over 5years so not only did they give me a loan for £1100 then interest is another £940 on top of that, if i take Natwest to court would i stand any chance of getting this back?????0

Please help. I have been through the whole process as described on this website and have just paid £120 to take Nat West to court. The only reply I have had throughout from Nat west was to acknowledge that I had sent a letter and that they were looking into my claim. This was a day before the 14 day deadline was up before I took it to court and I just took this as trying to stall the process so I went ahead and paid my £120 to go to court.
What happens next, I believe there is a form I need to fill in or something but i'm not sure
My total claim now is £1,680
Don't panic just yet. I heard absolutely nothing from natwest so just stuck to the deadlines and filed a claim on MCOL on the 11th of May. Got a pack through from Natwest this tuesday 22nd with an offer for £1550. They are paying up, you just have to stick to your guns. My success story is in the Success Stories thread. Go and read some if you want some positive support. There are LOTS of Natwest ones! The form only needs to be filled in if it goes through the whole court process. I'd just sit back and see what happens.0 -
Just wondered if anyone has heard that apparently the banks have found a clause somewhere in the claims for overdrafts. Does anyone know about this?
Apparently it's defending them against paying out so i am told.0 -
Today, after no correspondence from NatWest, and at the final hour before I take them to court, I received a letter from them.
It stated that they do not admit the charges are unlawful, and that they believe them to be fair and transparent.

However, we are prepared to pay you the full amount, sign this form, send it back to us and we'll transfer the money directly into your account.
Result!
£783 recovered.
Thanks to everyone for their help and brilliant advice, couldn't have done it without you, and thanks Martin.

You'll find a thread about "letter from solicitor/bank" and also one about "transfer of proceedings" both linked in the Reclaim Help Thread which is linked in my signature, have a read of them both to find out what to do or what will happen next.0 -
I sent first letter to Natwest recorded delivery and they logged receipt 26 March. The second was sent recorded exactly two weeks later. I called them once to establish progress and was told they would reply in 8 weeks. Today, bang on the deadline, I received the first bit of correspondence offering just under £5000 (my claim is for £7600 incl. interest). I called them to say I was not accepting and had already sent letters taking further action (which I did at 9am today). They said 'OK, so you are taking it to the small claims court?'. I simply replied 'Yes, something like that' and that was it!!!
I am proceeding via FO but have option to go thru' English court since my hubby lives in London. Can someone explain why I can't go for compensation....today alone has made me ill, let alone the financial restraints that have ruined my life for years? Also, eighteen months ago it became apparent to me that my branch has no disabled access for wheelchairs. I never needed this facility before. I have complained no end about this only to be told they don't own the building so it is not something they can fix. They have offered to come out to the car to do business!!!!! How insulting! The next nearest branch involves a 120 mile round trip!! Do they really want the publicity I am storing up for them?

Thanks for this, this is encouraging. Did you get back the full amount or were you offered a lower amount instead?0
