    Hi ya there is no way i am waiting 8 weeks to get my money i have been told it will take 14 days tops and thats all they are gonna get if not im gonna go crazy at them well Jo my 56 day is the same as yours so lets just wait and see what they DO.

    yes they have told me that it can take upto 14 days to pay out but are working on a 7 day turnaround..
    its me , you and timewilltell our dates are all exact..

    I'm in the same position as a few now. Filed claim via MCOL and a few days before the time was up i received a defence and request for more information. Now i have NO clue what to do next so could anyone point me in the right direction? Thanks

    You don't have to respond to the Cobblers defence. They are only stating what they will be using as their defence should it come to a hearing.

    The can ask questions, but at this stage you don't need to respond.

    It would be courteous to supply them any documentation that they may be missing, but again you don't have to unless the judge orders it.

    Basically their defence is BS, and is designed to have the effect it has done, i.e. scare you. Don't let them. If you aren't sure about anything ask here, there will be someone who can answer you.

    But please don't do anything or submit anything you aren't sure about and are doing so out of fear. Check here first.

    Kurt_Hamster, thanks for the advice, I will sit down and read the letter properly and then sort out what needs tobe sent and then let you all know my response to get the collectives thoughts. I feel less scared now and thanks for that it is reassuring to know there are others out there who are willing to help.

    I too have received a letter from Corbett's with a defense from Natwest.
    Basically it looks like to me they aren't giving in anymore with regards to the claims and are trying to find a way to dispute your claim. To be honest i wasn't too clear on what they were asking at first, but it seems i have to wait now until i need to take further action which will be provided by my solicitor.

    have received judgement forms from my county court with regards to natwest on the form it states that the court has made this order without a hearing, and if i object must make an application i have been given a date of the 14th august does this mean i have to attend the courts on this day thanks

    Nat West have filed defence and sent "Request for Further Information and Clarification". Says request is served "Pursuant to CPR Part 18" and are asking for a response to their request by 8th June.

    Reading various posts on this site it seems that the general concensus is that CPR Part 18 is not relevant to the small claims track (I am claiming £2,600 ish). Is there a standard response letter on this site. If not how do I respond.

    Also my account is a joint account. When making the claim online I only put myself down as the claimant and cobbets have picked up the fact that my wife is also named on the account. I have mentioned my wifes name in the "Particulars of Claim", but can I add my wifes name to it and if so what do I do.

    Any help would be appreciated. Didn't think it would get this far as they had already made an offer to me in writing. Seems a bit strange that they make you an offer, which has to be an admission of their wrongdoing, and then they go and defend. If it goes to court, would that go in my favour the fact that I already had an offer in writing?

    The easiest way round it is to submit a Form of Authority (to the court and a copy to the solicitors) from your wife stating that she is the other named account holder and that she gives her permission for you to act on her behalf.

    There isn't an official form as such, it's just a letter stating all the relevant info.

    Just head it at the top "Form of Authority" and get your wife to sign it.
