Frugalpam, thanks I was just about to ask what the notations mean, the request and clarificaiton document starts with 'this request is served pursuant to CPR Part 18 alternateively with regard to CPR Rule 27.2(3)' need to send response by June 8th.
They are requesting details of hte charges and account details, which I have sent to NATWEST but will send them again. and each time they are asking for clarification :-
a. is is the case should not have been charged.
b. If yes please expalin why the claimant contends that the same should not have been charges.
C. If no is it the case that the same should not have been charged in this amount
d. If yes explain why claimant contends that the same should not have been charged in this amount and identify the sum the Claimant contends should have been charged.
e. if no state case.
And finally, 'In your claim you stae the cahrges are "an unfair penalty under the Unfair Terms in Consumer Contracts Regulations 1999". Please specify all of the facts relied on in support of the contentions in para 3 and in particular identify the regulations of THe Unfair Contract Terms in Consumer Regulations 1999 relied upon by the claimant in alleging that the contractual provisions regerred to are uneforecable.
Yes I would like a copy of your letter and I am trying to hold my nerves, but like ripksi am very nervous.

Hiya - this is what I wrote back to Cobbetts :-I acknowledge receipt of the defence posted on behalf of National Westminster Bank plc, in your letter dated xxxxxxx.
I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative. <O:p
I am somewhat surprised that you have requested the information outlined in 2.1 of the ‘Request for further information and clarification’, since this information – in the form of a Microsoft Excel spreadsheet - was sent to National Westminster Bank PLC on xxxxxxxxx by recorded / ‘signed for’ delivery, and I have proof that this letter was signed for. Additionally, this same information was sent to MCOL on xxxxxxxx, with the request that it be attached to the particulars of my claim. It does somewhat concern me that you are dealing with this matter without having all the paperwork from your client, National Westminster Bank PLC.However, for clarity, I enclose a copy of the above mentioned spreadsheet, and confirm the charges I am claiming were applied to the following account: <O:p

Does anybody have any helpful numbers for Natwest - so I can get my statements quicker!!!!!!!!!!!!!!!!!!!!
I sent original letter 7th April, followed up with another letter 17th April (because I forgot to enclose the fee). So have taken dates from 17th April. Have sent 4 emails so far, as they told me on 9th May, they should be despatched within 7 days.
Received another reply 24th saying passing it on - again!
Sent another email today and told them I want it looked into as their 40 days have now expired.
Have also had several phone conversations but they just tell me have not had request, or they are on the system as being sent!!!!!
Think they are giving me the runaround.0 -

When I first got Cobbetts letter I felt sick to the stomach, but I gather it's their standard letter - they probably don't even check through case notes before they send it out: great solicitors, eh? :rolleyes:

Many thanks to yourself , Kurt and natwest staff. I am now at daughter's using her PC I could only press the thanks button and not type
Will have to take mine into the Computer DR. More expense.
The support from all on this site is what keeps us all going and is much appreciated .
I shall post off one more letter tomorrow It is worth it .
Anyone know though if they have or do 'withdraw' their offer
Also I am going to try and take a closed Mastercard on. I settled this last year but cannot remeber to account number and I have no remaining paperwork. I am trying to look at Experien Credit record in case it is on there but what about writing to RBS Mastercard giving name adress and date of birth. Anyone know if they can trace my records from this. Any other suggestions welcome0 -

Hi all. Just to report a success from Natwest. I got to the stage of filling in the MCOL form. However, i stopped short of submitting it as i needed some info that didn't have when i started. By the time i'd got the info and got some time to fill the rest of the form, Natwest wrote to me.
Full offer of £3290!! As a good will gesture !!! My Ar*e !! So cancelled the MCOL.
Looks like i've been lucky with a full refund of charges.

Hi,
I have just received a letter from Natwest offering the full amount of my claim which is £1697 but WITHOUT the interest which i have filed for in my court claim. With interest the claim is £2283.
Now on the 31st of May 2007 the 28day time limit for Natwest to put in a defence is up otherwise i can request a Judgement by Default and in effect get the full amount inc interest and the court fee.
As i only received the offer letter on Saturday the 26th of May and they've only got Tues and Weds to file a defence (Bank hol today), shall i wait till the 28day deadline is up and not contact them regarding the offer, therefore win by default or shall i call Natwest and say the offer is not good enough???????
Has anybody else had this situation and what was the outcome??????
