    Had notification today that my case has now been transferred to the local County Court. In the letter I received, I got yet another copy of nastywests defence, and cobblers CPR18 request. I've already written to cobblers to tell them the CPR18 isn't applicable in my case, and that I consider their request intimidatory.

    I rang the local County Court and told them that I'd replied to Cobbetts over the CPR18 - they hadn't been given that info, suprise suprise. He told me to send a copy of the letter in asap so that it could be put in my file, before it went before the Judge. Luckily I sent cobblers my letter by 'signed for' delivery, and can send the County Court that evidence also. I told the guy at the Court that I would also make it clear in my accompanying letter, that I considered that cobblers are trying to intimidate me, and that I have already reported them to the Law Society.

    I'm so sick of all this.... but so determined I'll have every last penny I've claimed off nastywest.

    Well Fatwesthave kindly sent me a copy AOS today - TBH I was a bit peeved as I would have liked them to forget and then I could get my money back - but wouldn't we all :rolleyes:

    What happens now?

    The only thing that does occur is that they verbally made me an offer which has never been forthcoming hence the Court action, is it worth ringing them up and pointing this out or should I leave it in the hands of a Court? Why did it have to come on a Friday :-(

    hi jonun,
    i am hols next tuesday for 2 weeks, 1st holiday in 15yrs. told my son to look out for the letter and to text me as soon as it arrives (if it ever does) if i have not got one on my return, then god help them as i have also been patient and polite. and i can only do that with them for so long.

  • Hello everyone,
    just after a little more advice if possible, I rang NatWest CRU on Tuesday to find out what was happening with my claim. I wasnt suprised to receive a call back advising they hadnt received my letter asking for charges back. I presume this was a delaying tactic. I was advised to email, so I did and today I have received this email:

    Thank you for your email.

    I have passed your email to the department that deals with complaints about
    charges.

    They will contact you directly about this within 56 days. This is in
    accordance with FSA guidelines.

    Again, I presume this is a delaying tactic.
    Now do I wait 56 days before sending the letter advising will proceed to court action in 14 days or do I wait until 30 May (14 days after letter requesting money back) and then send the letter advising court action within 14 days?

    who did you telephone today, do u think they wer just saying that, or are they actually doing it right now. they told me a couple of weeks ago that i should get a offer either before 31st may or 6th june, so that could be about right.
    i always seem to get the snotty unco operative ones when i phone. i might just phone on tuesday before i go on hols.

    i rang customer relations, he was still snotty and uncooperative..i had to prize the information out of him!
    he said i should receive my offer within a week...
    i read on another post earlier that somebody had to wait 8 weeks agian for the money to be paid into their account..not sure who it who or where it was now tho!!
    the 7th of june is when they have told me that my 56 days are up!!

    Hi ya there is no way i am waiting 8 weeks to get my money i have been told it will take 14 days tops and thats all they are gonna get if not im gonna go crazy at them well Jo my 56 day is the same as yours so lets just wait and see what they DO.

    Hi Steve - Natwest seem to have a habit of 'mislaying' letters.
    I'd personally stick to the timescales Martin laid out in his article. Send any letters by recorded ie signed for delivery - this has proved invaluable to me in the course of my claim, which is now being defended by their Solicitors.
    Keep copies of all correspondance to and from the bank, as if it reaches Court (which mine has done) you'll need to provide documented evidence of all contact with the bank - difficult to prove phone calls took place, which is why I haven't bothered other than once or twice early on in my claim.

    Hi, well the Cobbetts letter came requesting the information on charges as expected and the defence of the claim, two days before time was up. What do I do now, I know someone had done a response letter as I have sent the details to Natwest already twice infact. They are also requesting my defence on the consumer act. HELP, now am scared hoped it woldn't get to that stage.
  • HI i have phoned natwest say claim has been validated will get reply by 6th june i asked how much and their offer is about £600 less to claim incl interest anymore advice please dont really want court as already taking builder and is still ongoing 18mths down line as court is so bogged down with similar claims just incase do u have any idea how much cost and simple info how others are doing MCOL (TOTAL CLAIM £3317) THANX AGAIN
