i think your right..i do recall im my complaint form something along those lines..
however when i complianed to them they said i couldnt complain about charges as they were still in their 56 day timescale so i just complained about the lack of acknowledgement to my letters and that i get told different things each time etc!!
do you think i could claim via mcol now??

I have gone through FO I have copied this off there website hope it helps.
The ombudsman is a less formal alternative to the courts and it is free to consumers to bring a complaint to us. If you decide to go to court instead, you should be aware that if you lose you will not then be able to bring your complaint to us.Avid freecycler (Received Dishwasher, Cooker, 0ver, fridge, freezer and Bathroom suit)

can i just ask, i have complined to FO re lack of acknowledgement etc i was aware that the FO couldnt help me re getting my charges back..

ive registered with mcol just incase. but i dont want to do anything that jeopodises my case.

iv had such a day with fatwest today and i dont know what id have done without this site to come and blow of steam..

have complained to them regarding my charges with interest. I wanted to go through mcol as it seems quicker but I am off on holiday in 3 weeks and just can not afford it ( as I have two claims) FO will not take up your complaint untill you have waited the 8 weeks for the answer from the bank. I got mine off the natwest but without interst ( took 8 weeks) so I have had my final offer letter. So I have asked the FO to look into this they told me it takes around 4 months to sort out. So really you have to go with what is best for you. I can wait because I owe them £3000 ( i,ve asked for intotal £7000) and Its them depriving themselves of the money

Have a read of the FAQ on Financial Ombudsman website regarding using them to claim your bank charges. http://www.financial-ombudsman.org.uk/faq/answers/bank-charges_a1.html
Although they say up to 4 months to sort out a claim one user got his charges back 3 weeks after going to the FO.0 -
I'm currently trying to claim £4.5k from Natwest I sent my first letter in March and received no response and issued the second letter with a break down of all charges etc a few weeks ago and still no response. However I think I may have made a bit of a mistake, as I am also trying to claim for overdraft interest charges (amounting to approx £1k of the total claim), am I able to do this or should I have just claimed for referral charges etc?
As I have now got to the stage of court action, I really dont want to look stupid by claiming for charges that have been rightly applied to my account. Or do I have to start the whole process again?
Any advice would be appreciated.
You shouldn't claim for overdraft interest charges unless you can prove that they were purely down to bank charges and it sounds like they possibly weren't.
Provided you haven't actually started the court action I would totally redo you list of charges using the calculator in Martin's article and then start your court action with the correct claim. Alternatively send the letter before action to the bank again with your revised claim.0 -
Hi, just logged back on and everyone seems t obe having awful time with NW, as I have rejected their first offer and continued with mcol proceedings am I able to recind the rejection and complete their form and accept their first offer or do you advise to wait for the defence etc before doing anything else! Very nervous, not sure all this reading is helping my nerves with this. First Direct were easy.:eek:

The only response that I recieved, fairly promptly was the statements within the time frame. I have sent four to five letters as per Martin's templates and eventually placed a claim with MCOL. Still no repsonse . I tried telephoning,to no avail.Somone on this sight gave me an email number so I tried this prior to my hols. Whoopee !! A REPLY .It took them 9 days to say " We acknowledge your email and have passed it on to the appropriate dept" That was on the 7 /8/or 9th May
Have returned from hols tonight 18 th Mayand still no further emails
Nat west have acknowledged the MCOL claim and have until 25th to file a defence
I am tempted to respond to any defence or letter form Cobbetts " I acknowledge your letter"
However I am in a panic as there has been a complete silence, not even a partial offer and have returned from hols to read about the LLoyds win0 -

good on you for complaining. just to let u know that when i spoke to cru this week they said mine was in process of being validated, this would seem about right as our dates are near enough the same.0
