    Hi, Am reading the threads about Cobbetts Natwest laywers I am at the defending stage where they have acknowledge the claim on MCOL and am waiting for the defence. Who is Cobbetts and if I get a letter what can I expect and what do we do? Lots of questions just jittery.

    Cobbetts are Natwest's lawyers

    do u mean it was validated on may 14th, as march seems a long long time to wait for a letter. good luck



    Erm..yes I meant MAY 14th and have changed that.

    Is your defence of a similar wording? If so, do you know what the next step is that you are going to take? I've not had any paperwork from MCOL yet the defence was only lodged yesterday.
    Any advice would be gratefully received!

    Hi Jeni - have a read through this thread and you'll find the answers you need. Mine was a different letter, but again, the answers are in the thread I've pointed out to you.

    hi,

    im sat here in tears ...so mad with natwest!
    if you have followed my posts today you will know i was waiting on a call back from a manager.
    4pm still no call..so i rang them..no manager available, the guy i spoke to this morning..unavailable.
    so i asked somebody else to help me...No record at all of my ref number, so gave him account details..NO RECORD OF MY CLAIM AT ALL IN THE SYSTEM!!
    In haste i banged the phone down before i screamed!
    rang back spoke to somebody else who said' oh yeh we have your claim, usual 56 days bla bla bla'
    when i asked him about this morning , he didnt have a clue what i was on about , he just said my claim was in order and being validated!!!
    i told him i was starting MCOL, informing the FO, writing to my local MP and informing my local newspaper and informing the Law Society and the Banking Code Standrds Board..
    you couldnt make this up could you??
    I am sooooooooooooooooooo angry!

    Jonun - I really feel for you, and what you're going through.
    My advice: don't bother phoning, put everything in writing and send by 'signed for' delivery. Follow the time schedules set out. Use the FO to deal with your complaint or file through MCOL.
    Keeping on phoning is a total waste of time and way too stressful.

    1st thing monday im starting MCOL..can i do that even tho their still within 56 days?
    i need to research mcol as i havnt a clue what to write and how to word it etc!!
    my claim is over 5k so would i need to do 2 seperate claims?
    also the bank said earlier my spreadsheets werent acceptable so do you think they would use it in their defence in court??(even tho now the bank dont know anything about the spreadsheet conversation)

    Hiya Jo - have a good read through the MCOL thread which tells you how to fill in the form online, etc. It's really worth reading it all before you attempt to fill out all the details, so that you're sure you've got it right. Rex Mundi's posts early in that thread give a lot of really good advice.
    I'm not sure about claims over £5000 (mine was for just over £1000). Don't forget that the Financial Ombudsman will do all this free of charge for you, and you wouldn't have to deal with the bank or their nasty solicitors. Might take a bit longer, but it would avoid a lot of stress (I'm half wishing I'd gone down that route now, since Natwest have put in a defence, and it might take a few months anyway to reach my local County Court).
    If you do use MCOL, you submit the charge details separately - I filed my claim, then wrote to the Court enclosing the spreadsheet, and asked them to file it with the particulars of my claim.

    its just dawned on me tho
    that i have already complainrd to Fo a week sgo am i right in thinking they dont handle complaints if they are in the hands of the court?
