that i have already complainrd to Fo a week sgo am i right in thinking they dont handle complaints if they are in the hands of the court?

Didn't realise you'd already made a complaint to the FO - was that about your bank charges? If so, then probably best to leave them to investigate it, rather than starting MCOL - pretty sure you have to choose one or the other route (hope someone will correct me there, if I'm wrong)

Hi everyone,
I am trying to claim my money back from NatWest since March and I am now on the third letter, threatening Court Action, as thy havn't even bothered to reply or ackowledge my Claim. Has anyone else had this problem?? Do I still have a case if they havn't responded? I am not sure where to go from here, whether to give them more time. Your advice would be much appreciated, as I am getting very frustrated with it all. I am claiming £4K plus interest so can I still take them to Court. Please help.

I'm currently trying to claim £4.5k from Natwest I sent my first letter in March and received no response and issued the second letter with a break down of all charges etc a few weeks ago and still no response. However I think I may have made a bit of a mistake, as I am also trying to claim for overdraft interest charges (amounting to approx £1k of the total claim), am I able to do this or should I have just claimed for referral charges etc?
As I have now got to the stage of issuing court papers, I really dont want to look stupid by claiming for charges that have been rightly applied to my account. Or do I have to start the whole process again?
Any advice would be appreciated.0 -
I also have not received a response from Natwest for my claim of £4.5k, I'm now at the stage of issuing court papers, although I must admit not receiving a response is a bit worrying. Although I would definatley advise on persuing it further, after all persitence is the difference between success and failure!0

Damn sneaky Natwest!!
There I was, counting down the days til I win by default through MCOL - and they pounce with a defence, 2 days before the time limit is up! I'm so angry!
Now I have to wait another 14 days for them to conjure up some defence, another 14 days I have to wait for my money.

I've replied to Cobbetts intimidating letter, which requested information (CPR 18 request) which isn't relevant at this stage (if at all)
I'm still seething with Natwest and Cobbetts, so have made a complaint to the Law Society. Let's see how Cobblers like that ! :rotfl:

That's pretty typical of the banks. Be prepared to get a letter off [strike]Cobblers[/strike] Cobbetts next.

however when i complianed to them they said i couldnt complain about charges as they were still in their 56 day timescale so i just complained about the lack of acknowledgement to my letters and that i get told different things each time etc!!
do you think i could claim via mcol now??
