Hi, I wrote to NatWest on 11/04/2007 detailing my charges and requesting payment. They wrote back on 23/01/2007 saying they were 'investigating my claim' and would respond as soon as possible, but i've not heard anything since.
I presume I can send off the second letter now?
ALSO, now the date has moved on, the schedule spreadsheet calculates a different amount of interest to that which was originally mentioned in the first letter. What do I do about this?0 -
I have lodged my Notice of Issue of claim at County Court and received it stamped today confirmation it was issued on 13th May. What are my time limits now?0

My partner and I are both in the process of reclaimimg our bank charges, and after sending the first letter requesting the 6 years of statments for my partner from his bank NatWest he has only received statments from 23rd Feb 2001 to 27th Sept 2002. This is only 1yr 7mts worth of statments. Am I going to have to write again sending another £10 or should i just write and demand the rest of the statments i asked for?

Had the same thing happen to us. Ask for 6 years worth in March 2007, and have the first 18 months missing. Got fobbed off by saying it was when they merged with the RBS. Sounds to me like they are delaying statements so they won't have to pay!:mad:0

Hi all.
Is there anywhere where I can post to see which of my charges (Natwest) I can apply for and to what exact date? Especially the six pound charge, I don't know what this is or if I can apply for it. Maybe an account charge that they've changed me onto without asking me?

Have you got an advantage gold account? The fees for this have gone fron £6 to £9 and now £12. I'm not sure when the increases were, but you cannot claim for these. you would have to deduct this amount off the charge. e.g when I go over my overdraft The charge at the end of the month is shown as £40 so deducting the £12 for advantage gold fee the claim would be for £28.

and at what stage did you contact FO..
Im just asking out interest as i sent my 1st letter to natwest 12th april and i have had no contact at all..so i complained to Fo last thursday hoping this would speed it along but 4 months is a long time isnt it? is the 4 months before they even look at your complaint?

Wrote first letter on 17 March they state they did not get it
sent second on 3rd April recorded delivery
Rang many times ( got angry at first then rang them just for the fun of it:rotfl: :rotfl: :rotfl: )
They told me they had 8 weeks from 3rd april to investergate
rang on the 1st may threatened FO offer with me within 4 days (without interest)
Contacted FO this week and e-mail fatwest my intention( still awaiting answer shock horror:rolleyes: ) told by FO it takes 4 months on average to write out ect and bank to settle (i can wait as I owe them £3000 awaiting unidebt to contact demanding banks money and I will tell them when they pay me I will pay them ha ha:rotfl: ) And this is my last debt yippie. So I can afford to wait I know other people cantAvid freecycler (Received Dishwasher, Cooker, 0ver, fridge, freezer and Bathroom suit)

I am/was with advantage gold however I never requested it. The only time I had advantage gold mentioned to me I was told that it was free. If I tried to claim for a fee that I shouldn't would that void my entire claim?

This is the timescale of events (with thanks to Edinburghlass, who posted it originally) with regards to MCOL

TIMINGS ON MCOL
Once you file your claim, you will see this:
Status: Requested
Your claim has been submitted to the court for final validation before being issued.
Then, usually a day later, it reverts to this:
Status: Issued
Your claim request has been accepted. The Defendant has 14 days from the date they are served with the claim, to reply. The court will send you a “Notice of Issue”.
The court allows five days for the claim to be deemed served, even if the bank acknowledges before the five days are over. If the bank does not reply within the 14 days after the claim was deemed served, you can enter judgment by default.
Status: Acknowledged
If the bank acknowledges at any time within those 14 days, they now have 28 days from the date of service of the claim form to file a defence. The court will send you a “Notice that Acknowledgement of Service has been filed”. If the bank don’t defend, you can enter judgment by default after the 28 days are up. If that date falls on a weekend, the court allows one or two extra days for them to respond. You will know if you are too early, as the system will simply not allow you to enter any judgment before the time is up.
Status: Defence
If the bank defends before the 28 days are up, you cannot enter judgment or do anything else online anymore. The court will send you a “Notice of Defence”.
If the bank is just biding time before they send you a cheque (and have told you so in a letter already), you might be sent a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so.
If the bank defends with the purpose to go to court, you will be sent an Allocation Questionnaire which you have to fill in and send back to the court. A court date will then be set which you are required to attend. The bank will either settle with you in any way before the court date, or they will not turn up on the day and you will win by default.
This is how it usually happens. Alterations from the norm are possible of course.<O:p</O:p

Hi. Natwest only charge £5.00 for this service, so don't give them more than you need to!
I sent my request to the details on the main thread with the list of banks and regulatory departments.
They have not been the fastest of the banks though. I sent my request on 17th April and still waiting, but it seems everybody has a different story to tell.
I have emailed them on several occassions to remind them I am still waiting. They have now sent me an email stating that statements will be despatched within 7 days - lets see!!!!!

Thanks so much for your help on this, I would've sent the £10 and I'm sure they would've just kept it, another £5 they owe me to add to the list! Can you remember who you made your payment payable to? I just don't want to get it wrong only for them to delay anything even more than is necessary! Thanks again.0
