Hi everyone,
I am at the court stage, "Naffwest" were served on the 8th May (havent heard a thing from them yet)
I need a bit of advice.....
I have paid cash into my account to cover some chqs and dd's, but they seem to (like some miracle) crossed in transit and hey presto £146.00 in charges added to my account in 2 days!!
Does anyone know if I can alter my claim with the courts and included these new charges?? I have looked back over the last 10 pages and cant seem to find an answer!! I am so stressed at this whole thing, I really need the money NOW, things are a struggle!!
This is my story so far.......Are you sitting comfortable, I will begin!!!!
If it wasnt for Naffwest, I wouldnt be in this state.
I had a large overdraft (£2700) that they wanted to HELP me clear off with a loan. I had never asked or used the overdraft, they just kept increasing it every six months or so. Then my unfaithful moron of a husband left me, and surprise surprise I needed to use it!! Anyway it was up to the top every month, but never over it. They offered me a loan to clear it. I said I cant aford it, they said they had looked at my outgoings and I would be better off!! What a joke, 18 months later and £2000.00 in charges!!
I hope to get the charges back and tell them to stuff the account and their loan!!!! I am currently in a debt help programme and they can whistle for their loan money like all the others once I get my charges back!!!!0 -

I am at the stage where natwest has sent an offer on my 2 claims but without interest I will be over £2000 short of what I asked for. Anyway to cut a long story short I phoned the FO and they will investigate but it usally take 4 months due to the huge demand. But they also said they have not had to get as far as investing any claims yet as the banks have settled with goodwill gestures(4 months is still the time scale). I would got down the MCOL route but I just do not have the money for two claims.
I hope this helps people
Nikki
(my claim form is on the way)
can i just ask you , how long from sending your 1st letter to receiving an offer?
and at what stage did you contact FO..
Im just asking out interest as i sent my 1st letter to natwest 12th april and i have had no contact at all..so i complained to Fo last thursday hoping this would speed it along but 4 months is a long time isnt it? is the 4 months before they even look at your complaint?
many thanks

Good news about getting all of your charges. The banks always leave things to the last minute and now, as a result, they also owe you your court fees. Write back and advise them of this.
The interest is always a bit of a problem, as - strictly speaking - you don't have any legal right to this, unless it is awarded by a court. Even if we knew how much this is, the decision whether or not to keep on with the court claim to reclaim this is one only you can make. The acquisition of wealth is no longer the driving force in my life.0 -
thanx that has put my mind to rest a bit.0

We posted letter through door of Royal Bank of Scotland on Monday 7th May (Bank Holiday) requesting charges levied on my partner totalling just over £3000 including interest.
Thursday 10th May 2007 recieved 3 responses (one for each account) from RBS saying they were considering the claim. I hope they are just as quick to pay it. Anyone had any experience with RBS and what shoudl we expect?Working hard to reduce debts and get better value for money0 -
i have gone through the process of trying to reclaim my bank charges from natwest.
i have written the first letter, asking for the amount including interest, then the second letter threatening court action. i waited 14 days then proceeded with the moneyclaim action. two days later i recieved a letter from moneyclaim stating that my claim had been processed and i also recieved a letter from my bank offering, as a goodwill gesture!, to pay back all the bank charges(without interest). now i dont know what to do as i cannot cancel the moneyclaim case, and i have paid the £120.00 costs. has anyone been through the same, or know what the best thing to do is!!!
i'm in the same position, got an offer letter from Natwest for all the charges on Saturday :j . I rang them to say i would be happy to accept if they refund me the £120 court costs as well, and i'd forget about the £700+ interest. Was told that they are not refunding any court costs as that was my choice to go ahead. Unsure what to do now as i really want it over with and money in the bank, but feel like the court costs are a principle thing. Anyone else got Natwest to pay up the court fee?0 -
I received my offer letter on Saturday morning:j :j :j :j :j
I originally claimed for £2 900 which includes the 8% interest and Fatwest have offered me £2 300 which I'm very happy to accept.
I've posted my acceptance off this morning (and e-mailed a scanned version) and kept a copy for myself just in case it goes missing.

HI - sorry if this is a really stupid question but I really don't want to have to phone Natwest about this, I can't bear talking to them. I need to request my statements and will be putting a cheque for £10 in with my letter. Does anyone know who I need to make the cheque payable to? Many thanks in advance for help on this.0

Hi All,
Just thought I would keep you updated.
I received an offer from Natwest today :j for the full amount of charges obivously not including interest or court cost. Im undecided as to what to do but am leaning slightly towards accepting - its very tempting.
But I filed with MCOL just over a week ago and Natwest has til Sunday to acknowledge the claim so im thinking of holding out on sending the acceptance letter off until Monday just in case they dont acknowledge and then I can ask for a judgement which would included interest and court fees, what do peeps think??
Also does your claim online get updated when they have acknowledged to say it has been acknowledged?? Cause online it doesnt even say it has been served and otherwise how will I know if they have or not??
