I have had letter from Cobbetts asking for full details etc back in March - which I replied to. I have completed the AQ for the court and also received a copy of the AQ response from Cobbetts in which they state:
'I have not shown reasonable grounds for bringing claim and that despite them asking for it, I have failed to provide etc. Case management directions cannot be proposed until the claimant fully particularises claim. In light of this the defendant may amend its defence or apply to strike out.'

Oh Yes, I got that! It's a delaying tactic and a bluff intended to frighten you off. What I provided them with was a statement I had kept going in Excel of all charges and interest debited by Natwest on what dates. In my reply, as well as my claim, I made it clear that the total was the total to date, subject to any charges that might be made, up to the day the matter was resolved.
Considering that you will already have detailed these figures in your complaint to Natwest, you should make clear, like I did, that it is not your fault if their client has not properly instructed them! But you should send copies of any documentation you send Cobbetts, to the Court also.
As for the pages of guff they (Cobbetts) will write disputing your assertion that you are claiming on the basis of The Unfair Contracts Act, and demanding that you quote which particular clauses in that Act you are relying on - just ignore it completely. Your case has been made by simply mentioning the Act.

Hi , I am doing a claim for nat west , I have recived the statements , just looking trough. when i close my account they have taken the followin charges referral to close20.00
charges to close 421.08
charges per d 3.00
interest to close 96.36
interest to close 1.166.33
Which one of these I can actualy claim back, this is very confusing but I am sure i will get there . thank you

hi all
i had 2 accounts with natwest i am claiming back charges i ran a small business which has now closed
i had a business account
and a personal account
the business was overdrawn by £1500
and the personal was overdrawn by £900
i made a claim for the return of charges
business £1900
personal £1500
i have been offered this in full but the accounts are closed so how would i get the money back as they say they will only credit my accounts and not send me the payment
any help on this.

were they closed or were they passed to credit management services or do you have an agreement in place to pay back the outstanding amount? If it is the latter then they may be open for credits only, so the debt should effectively be wiped out and the outstanding amount would then be sent to you in the form of a cheque.0

Shall I send another letter to Cobbetts (and a copy to Court) stating the original details and list of charges and interest? Or wait and see if the court asks me to do anything?
Also did you get interest up to the date you settled or based on your original calculation?
Also how long from this point in the process did it take for you to get an offer?

I got the interest charged to my account up to the date of settlement. Given Natwest's interest rates, this was of course more than the statutory 8% provided for by the (exellent) calculator on this site.
Also how long from this point in the process did it take for you to get an offer?
Like I said in my post, 5 months! They will not allow it to get to court, and brinkmanship seems to be the order of the day - which is a two-edged sword!0 -

hi all
I am at the stage where natwest has sent an offer on my 2 claims but without interest I will be over £2000 short of what I asked for. Anyway to cut a long story short I phoned the FO and they will investigate but it usally take 4 months due to the huge demand. But they also said they have not had to get as far as investing any claims yet as the banks have settled with goodwill gestures(4 months is still the time scale). I would got down the MCOL route but I just do not have the money for two claims.

i have gone through the process of trying to reclaim my bank charges from natwest.
i have written the first letter, asking for the amount including interest, then the second letter threatening court action. i waited 14 days then proceeded with the moneyclaim action. two days later i recieved a letter from moneyclaim stating that my claim had been processed and i also recieved a letter from my bank offering, as a goodwill gesture!, to pay back all the bank charges(without interest). now i dont know what to do as i cannot cancel the moneyclaim case, and i have paid the £120.00 costs. has anyone been through the same, or know what the best thing to do is!!!0
