just send the second letter after 14 days. they will just stall time saying 2 months for an inquiry.

Ok so it's got to the point now where I'm seriously thinking of giving up. Started my claim back in March, stuck to the timescales and heard nothing back whatsoever from Natwest. Filled with MCOL and it was issued on the 22nd of April, same as FrugalPam. They had until Sunday to acknowledge and some crazy optimistic part of me thought maybe they wouldn't. But yesterday they did.
Just not sure now if i have the will to carry on with it all. Having to fill in more forms and deal with their defence just seems too daunting and the thought of it dragging on through all of summer gets me down. I've a baby due in 7 weeks so enough to think about. However i've got bills mounting up, and still getting charges every month so really do need the money. Anyone got any words of encouragement to keep me going, or should i just admit defeat.!!!

Hiya - just read your post and Paw's reply to you. PLEASE DO NOT ADMIT DEFEAT !! This is exactly what the banks want us to do, and we all need to stand strong together on this :T
If they do file a defence, then its easy to deal with as all the standard replies to their silly letters are here on the forum. At most you'll have one letter to send, and that will be it. Cobblers... oops Cobbetts... just push a button and send out their letter, and we just have to get in the mindset of playing them at their own game. They almost always back down before it gets to the Court stage and pay up everything claimed, or else don't bother to appear in court. I'm trying to treat it all as a game, and not take their silly defences or letters personally. Please PM me if you want a bit of moral support in all this. We've got too far to give in now, and just think how nice it will be to have our money to throw back at debts or treat ourselves/family.

    take care,
    Pam

If it got to Bailiff stage with my bank, I'd love to be able to stand there and wag my finger at the Manager and say 'Who's a naughty boy then? :naughty: :rotfl:

I wonder if they get slapped with penalty charges when they don't pay up after judgement?

Hi, this is my first post and straight off i want to say thank you to you all...especially Martin for giving me the courage get on with claiming back MY money.

The trigger moment for me was when in one week they took nearly £200.00 in charges, and wouldn't listen or try and help.... as fast i scraped the money together to chuck in my account to try and forestall the charges, they grabbed it and left me in hell of a mess!!

My eureka moment came after a lot of tears and self recrimination... i thought to hell with it, if they can play dirty ...then i can do this and not feel guilty at all...... i do admit to not being the best at managing my money, but i would be a lot better if i had ALL my money to pay my bills with!

I sent off the 1st of Martins letters on 14th April. Stupidly i didn't send it recorded delivery, i was in too much of a hurry. I rang Natwest on 23rd April and asked how it was going.... they hadn't received anything, so i requested them over the phone, i received 3 years worth of statements on 2nd May.

Absolutely horrified at the toal, £2625.00 without interest and £2890.78 with interest, just for 3 years!!

Can anyone let me know how long it normally takes for the next 3 years worth to arrive? Should i put in a claim now or wait till i have all the statements?

I'm chomping at the bit to get going!! lol

Up to 40 days if the request was made under the Data Protection Act. This should be in writing though, so it's unlikely your request was treated as such.

Don't send off your Initial Approach letter until you have the details of all the charges you are claiming for.

Has anyone had more charges put on their account AFTER they have started MCOL? Im note sure if Particular of Claim can be amended after the hearing date given - mine is 4 July - anyone else in same situation? I have a further 200 put onto my account since starting the claim Jayneg
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    Hi,
Can anyone tell me (as a general rule) how long it takes for the banks to reply to the initial letter requesting your bank to repay your bank charges.
I sent the letter to my bank (Natwest) exactly a month ago and still have heard nothing from them. I wondered how long I should leave it until I send another letter pointing out that not only have they unlawfully taken my money but they've also been extremely rude by not replying to me at all.
    I’d appreciate any advice.
    Thank You.

You send your second letter after the number of days you gave them in your first letter.

The banks are not going to fall over themselves to reply to your letter. Set out a timetable in your own letters and keep to it.
