    Snap....also got my "Notice of Acknowledgement" from MCOL today stating that they are going to defend all the claim.

    Has anyone else got to this stage with Natwest? What happens after this (in reality)?

    Thanks for the moral support you two! No way am I giving up, and I've got myself back into yesterday's mindset, and just treating it as a game from now on. I suppose Natwest have got to keep Cobblers in business :rotfl:
    In retrospect, it is amusing to see Nastywest cited as the Defendants, after all the grief they have given me over the past few years !!

    And congrats Paw on getting your money back - I was just reading over in the 'Successes' thread. Brilliant news !! :j :beer: :j

    I WILL get my money back and looking forward to that celebratory lunch :T

    Hiya Phil - just been reading over in the 'Successes' thread (and delighted to see that they've paid up Paw!) I'm reading that they do pay up sometimes before filing their defence, saying its not worth the expense of defending blah blah. Makes you wonder why they just don't cough up when the claim is served on them. Just smacks of a greedy, petulant institution to me :p

    Please don't give up - there's plenty of help on this site, and Consumer Action Group website. I've copied the letter I sent Robbers - oops, I mean Cobbetts - below, I copied it from someone else on this website! Don't be intimidated - even if you go to court, they won't send anyone, you just need to tell the judge what the charges were & s/he will agree to the refund, that's what has happened to the others who have been through the process.

    Keep your chin up, don't be afraid to ask for help, even if it's just moral support. I feel much stronger when I read that I'm not the only one!

    I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative
    Furthermore I consider that the CPR part 18 request is intimidatory and I intend to bring the intimidation to the notice of the court. However, for clarity, I confirm the charges I am claiming were applied to the following account:

    I followed the timescales with letters 1 & 2 on 28/02 and 14/03.
    Submitted to MCOL 28/03/ and now had one letter saying they are going to defend the full claim 18/04 and undated offer of refund of charges from Nat West.(Rec`d 24/04) No interest or court fee.
    Next a defence letter from Cobbetts 01/05 requesting information and clarification. I did reply to Cobbetts with info but thanks to you i will now send a follow-up letter including the above. Thanks again.

    Ive found my parachute account to replace my Natwest with Yorkshire Bank. Their basic account is the only one that gives a maestro rather than visa electron or solo card. No cheque book, but the card has all the other uses as my natwest switch/maestro.

    Sorry for the dumb question. I've finally got the majority of my statements, bar approx 15 pages (can't be bothered to chase those, Natwest have f**ked me about enough trying to get the statements I have already) and have totalled up my charges.

    When you send the letter asking for the charges back, how have you listed them? By the date and amount charged?

    Also, can someone be so kind to paste the addy to send my letter to Natwest to? I can't find it on the forum and am going round and round in circles trying to find the post with all the bank addresses on.

    you will find everything you need on the main site. Use Martin's template letters and calculator it will work it all out for you. I sent all my letters to my local branch.

    Frugalpam i have had the exact same letter this morning too and it does say that they intend to defend claim but if they don't put a defence in by the 21st of may we can still win by judgement( i think ) so they must be dealing with us exactly the same so hopefully they wont put a defence in.

    I just used Martin's calculator, you just put the charge and the date and it adds it up for you with interest, I just printed that and sent it with my letter. I didn't put what the charges were for but there is a column to do that if you want.
