    As a rule you can't claim interest unless it was the banks charges that took you overdrawn, so generally no you can't claim (would be nice to though!)

    Use the calculator for EVERY charge, once completed send a copy with your letter to the bank. Remember to keep copies of everything you send for yourself & send everything recorded delivery so you have proof of postage & that they have received your letters.

    Edited to add: You can claim 8% interest on each charge from the date it was applied to your account if it gets to the MCOL stage. (the calculator works that out for you which I printed off from the outset & sent along with my letters, just so the bank could see what I COULD claim if it were to go to court ;) but I didn't ask for it) hope this helps.

    I sent my offer letter back recorded delivery they received it on monday thought i would give them a quick call today to see when the money would be credited and was told it could take 3 weeks to add the reply onto the system then 10 days from there!!!!

    I said thier 8 weeks is up next thursday but they told me that as soon as an offer is made and accepted that the case is seen as closed! They aint silly are they! Anyway i have not cancelled my complaint to the FO so will just report back to them if i dont receive the money by the end of next week

    Hiya, I never give it a thought to ring & ask when they will deposit it to my account, I've looked at other successes & most seem to take about 7 days so I was hoping for that really. Thanks for that info Katie, told you I'm not celebrating until I get the money back :D

  • I have just received all my bank statements from my bank, Nat West, but the charges on the statements dont specify what they are charging for, it just states charges then the ammount so I'm having difficultys trying to work out which charges I can claim on. Can any one help.
  • Hi every one hope some one can help me, my claim has been put on the fast track without an AQ and i have to put a pt 18 reply together, i have searched the site but can't find any threads with info for such a request, there are plenty stating that its not applicable because its less than £5000, are there any templates as i believe the questions are pretty standard, (if you are called Rumpole,) any help would be fab.

    Will update as soon as i have it! :D Im a lot calmer now i know ive actually had an offer though, it was the not knowing that was annoying me! lol

    I am supposing we will have to give them an extra day due to the bank holiday weekend.

    On another note though my auntie called them about her offer and they said they had not recieved the reply and she told them as the 14 days were up from when she sent the reply back she was going to court the woman put her on hold nad hey presto money in her account! The woman says it had been there all day but my aunt had checked that morning and nothing so she must of done it while she was on hold.. But that was with them saying they did not have the offer letter!!

    Don't feel intimidated at the thought of taking on the bank to get back what is your money. Yes, they're a big institution, but remember that they have had to refund literally thousands upon thousands of people with money they took unlawfully.

    Don't be worried if they defend your claim and it goes to Court. Many a time they then go on to refund you all your money, even before the court date. And if it gets to the court date, they simply don't show up to defend themselves - result: you get your money back!

    You set the timescales - see Martins article for template letters and the timings of letters. If you speak to them during the process and they mutter to you about them being 'very busy' or that 'its going to take several weeks' - you simply don't have to fit in with them. It is up to them to fit in with you! You might choose to wait, or maybe simply can't afford the court fees - its your choice. Don't forget, the Financial Ombudsman will take up your case if taking it to court isn't an option.

    Do ask questions here - many of us have had the same questions in the past and one or more of us will come along and try to help. There are also the seasoned veterans like Rex Mundi, Martin and Edinburghlass who have a wealth of experience and advice, who will help to point you in the right direction.

    Nice post and very kind. I know most of what the newer people are asking has been addressed in much MUCH earlier posts but, as I found coming in on this a bit later in the process, it is daunting and trolling through many posts is a bit heavy work with a heavy heart. Sticky has a great link which covers the basics and should be promoted to ease some of the understandably endless questions for the new people taking a stand.     One last comment...
    I am at the one last pre-court stage. Emailed like mad to customer relations and finally uttered the immortal words 'Financial Ombudsman' and suddenly stops seem to be being pulled. This might be a tact to consider in earlier proceedings?
