Hi every one thought i'd have my say on here and let you know how i'm getting on with my claim with Natwest.
Requested 6 years statements on the 19th february 07 got back no problem didn't even have to pay for them infact they sent me the same statements twice.
Calculated all the charges and sent 1st letter to natwest on the 13th March 07 giving them 14 days to reply. No reply
Sent 2nd letter to natwest on the 30th March giving them a further 14 days to reply or i would be starting the court process. No reply
Started my MCOL process on the 16th April (was due on friday the 13th) but couldn't bare to due it then so went for the next working day. It was deemed served on the 22nd of April and they have until the 6th of may to acknoledge which is a sunday so can't send judgement until 12o'clock midnight on the tuesday as it is bankholiday.
I have not heard a peep out of natwest and am waiting with bated breath until i can send judgement if they dont acknoledge. I feel sick when the postman comes in a morning all i do is read all your threads which keep me going and all the success stories and are put on here if it wasn't for your lot i don't think i could have got this far.
I never rang them couldn't see the point as alot of you say that they just fob you off, and i know that they have recieved my letters as i hand delivered them to my local branch and then got one of the ladies to sign to say that they had recieved them.
I just feel like they are going to make a stand with me at the last minute and really send me to court and then i will be really stressed but i would do it 5K is a damn well lot of money that they stole off me in my time of need. So all you decent people out there giving us newbies some advice keep it up as it gives me a right buzz.:)

Hiya - sounds exactly like the process I've gone through, and even the dates are similar.
I'd just say DON'T get stressed about it and worry about it reaching the court stage. The banks simply do not turn up in court because they cannot defend the charges they've applied. Even if they defend the claim and you get a court date, they will not turn up, and the judge will find in your favour and you WILL get your money back!!!
I don't know why they bother defending some cases, as they always have to pay up in the end - don't be spooked by any of this, honestly.

Thanks for that frugalpam. I really don't know why i'm getting stressed about it i just am. Its the thought of taking a massive company like Natwest to court and a nobody like me can win them. I don't even know where they are in the process of these claims .some people get a offer after 1st letter some after the second and so on and then there are people like me that have heard nothing whatsoever. I personally think that the banks are in such a mess of all the publicity that we can all reclaim these charges that they just can't cope with it all. i think that they should set more people on to get through it they should set me on and i'd just say yes to everyone.lol

Can anyone suggest what to do next, I sent for my statements on the 14 March, 40 days up on the 23rd April, still no statements. Send another letter using template by Rex Mundi, thank you, on the 23rd April by recorded delivery to Edinburgh address giving 7 days to send my statement, still no statements. What do I do now, cause at the end of the day, it's my statements I want. They just seem determined not to send them. Any advice please.

Hi, the next step would be to make a complaint to the Information Commissioner. This can be done at www.ico.gov.uk

It may be worth just phoning Natwest to let them know of your intentions - It might wake them up!

If your account is still active, you can just request the statements by phone or in the branch for a £5 charge.

    I hope this helps.

I have already sent a cheque for £10, and asked for them on the phone twice, cheque not been cashed, but they have received both letters.

A complaint to the ICO might be the only course of action left to you. It's an extra inconvenience but maybe a necessary one. I'd still phone Natwest to tell them you're about to do it though - they might take it seriously.

    Hi all

I have got one of my offer letters today I have requested £3300.00 including interest on this account they have offered £2465.00still awaitng an offer for the second account of £3800.00.I put my first letter in 17/3/7 this went missing I wrote my second letter on 2/4/7 and sent it recorded delivery after many good and bad phone calls I was told yesterday an offer letter was sent out. To my surprize it landed on my doorstep this morning.
I am torn weather to accept as MCOL will cost me £240 for the two accounts and I am due on holiday next month if I accept I will only have a £400 debt left with them. Has anyone contacted them after an offer and negotiaced a higher ammount I might try for the extra £400 to settle the debt. This is soooooooooo hard:confused::confused::confused:

You might well be lucky like Paw, and get an offer letter very soon - I'll keep my fingers crossed.
Your other route would be the Financial Ombudsman - the banks really are wary of the FO, and of course they'd follow up your claim free of charge. Have heard of a lot of successes by going down this route.

PS The Natwest woman I spoke to this morning must have graduated from snotty school with honours :rotfl:

Thank you for that Pam. Like all others I just want a resolution. I am not impatient but feel it almost my duty to stick to the deadlines just to put the bank under pressure (as they have to all the people here). The bank have banged on another £76 in the last two weeks purely due to their non-communication with me. It seems they are getting narkier by the minute!
Your comment about referring to the Financial Ombudsman was inspirational as I have these emails, pertaining to my basic complaint, with no home to go to! Now they have!
