hi, if it is any consolation I am still waiting for my bloody statements its getting on for three weeks now and am getting despo, got charged the other day for a 2.20 ddand they charged me 38.00 for this when they knew my wages was in the day afterso what happened then was cos they had charged me other stuff that needed paying there was no money there so I was charged all in all 176.00 pound and I only work part time so half of my wage was took up paying the bloody charges but cos I am still waiting for the statements am getting fed up and feeling not getting any where, well thats my moan for today.
I know how frustrating it is, as I had a long wait for my statements too !
Just take comfort in the fact that you can reclaim every single charge for returned DD's etc - EVERY SINGLE ONE !! :T :T And if they don't send you those statements in the 40 days then you can report them to the Information Commissioner :T

Hi, I have taken Natwest to court. I was sitting here quite happy waiting for a court date and all of a sudden i get a "General Form of Judgement or Order" in the post stating the following:
Before District Judge blah blah
Upon the courts own motion. the court has made this order of its own initiative without a hearing. if you object to the order, you must make an application to have it set aside, varied or stayed within 7 days.
It is ordered that:
1. directions will be given in this case by the designated civil judge on 14th august at 10.30.
2. the parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the court and othe other side at least 7 days prior to hearing".
What i would like to know is: Is this my court date and do i have to do anything.
All help would be greatly appreciated.

I know why I'm not as excited as hubby thought I'd be, I'm fuming :mad: this £4,000++ that they STOLE from me got me in so much debt, having to go to the CAB for financial advice, people phoning me, sending me debt letters ect ect, if it wasn't for Natwest I'd have kept my head above water & paid my bills, fed my kids, EVERYTHING! I don't consider myself as "winning" these charges, I consider the situation as justified, just wish I had time to do the MCOL then I could have got £800+ interest that could have paid more bills Natwest got me behind on. How can they justify charging me £38 for going 9 pence NINE PENCE overdrawn :eek: ????????? THEN charging me AGAIN for being over my overdraft which THEY took me into, NOT ME.....THEM!!!! ggrrrrr:mad: They dont warn you (like Abbey for example) they just slam the charges on as & when they want to so you CAN'T do anything about it..................as soon as I get this money back I'm closing my account, never to have anything more to do with Natwest again! I HATE THAT BANK :mad:

You will definitely get your money back, just just a case of WHEN then we will be :rotfl: all the way to another bank :T

The woman I spoke to at Natwest today was really snotty, saying that they would not pay me interest or my court charges and that their offer was final. Ha !!! I took a huge amount of delight in telling her that actually I WOULD get interest on my charges and I WOULD get my court fees refunded. Deadly silence at her end....
Isn't it nice to no longer feel intimidated by Nastywest :T

Absolutely right there Matey, I really don't feel intimidated by them anymore, I can make a fresh start, new bank, new account, dealing with & on top of my debts :j
Funnily enough I'm feeling slightly better this afternoon AFTER my rant about natwest this morning, maybe the gorgeous sunny day has a lot to do with it
Good for you putting that woman in her place, I've only spoken to really nice advisors when I rang, there's no need to be stroppy or arrogant when talking to you (I know they get fed up but they knew what they were getting themselves into when they took THEIR job), they can no longer dictate to you, YOU are in control :j :beer:0 -

As i might be abroad for a summer course, i wonder which is the best way to deal with it. I have called Natwest before sending the last letter as i had not heard from them, and the person told me 'we can take up to 8 weeks to reply'.

Hi, I'm not clued up on the MCOL stages or beyond that but here's one of the quotes from Martins pages:

EVEN IF IT DEFENDS THE CLAIM, DON'T WORRY. If you’re one of the few cases where the bank does enter a defence, don’t worry too much, this is pure posturing and in almost every case is simply a way to try and make you settle, or argue that you've asked for too much (e.g. you've gone beyond six years or tried to claim compound rather than statutory interest).
At this point you’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. The next stage should be a Small Claims hearing date, yet this virtually never happens, as the banks tend to offer a settlement at this stage. If you get right to this stage and want help, it’s worth using the further resources.

I issued a claim on the MCOL site on the 26th of April, when i got the confirmation letter the issue date said the 13th of April!!!! and on the 2nd of May the 14day time limit for Natwest to reply would be up and i will win by default.
Shall i call MCOL and say they have incorrectly put in the issue date or shall i just leave it and let Natwest spot the mistake??

14 days is 14 days, not working days, so this will have expired on the 30th April.
You can file the claim, but make sure your post is checked every few days to ensure you can respond if the court requires any more information.0 -

If the bank defend the claim, it then comes out of MCOL and gets referred to your local Court. You might be sent a court allocation questionnaire, but I'm hearing that doesn't always happen now, as the judges know the bank won't turn up to defend anyway. You just need to wait now and probably the next thing you'll get will be a court date.
Its not happened to me yet, but I've been swotting up incase Natwest decide to defend my claim after I told them I didn't want their partial offer !!
