Dear Sir/Madam

Please accept this correspondence in accordance with my duty under
the Civil Procedure Rules to continue to pursue a settlement without
the
need to invoke the time of the courts.
Further to my 2 letters dated 16/03/07 & 30/03/07 requesting refund
of charges & our telephone conversation on 04/04/07 regarding the
settlement
offered by you and accepted by me thus far I have not received payment
or
any explanation as to why not. I consider this time more than
sufficient for
a company such as yours, engaged in the business of consumer banking,
to be
able to process and execute a payment.
Take notice that should I not receive payment of the £4***.**
offered without delay then I reserve the right to issue a claim against
you
for the amount of £4***.** plus interest pursuant to statute and court
costs and without further notice.
Finally, should I be forced to litigate I intend to draw the Court's
attention to the fact that you have not made any effort to conclude
this
matter, in addition I will make a formal complaint to the Law Society,
the
Financial Ombudsman Service and the Banking Code Standards Board and I
will
submit this letter to the Court as further evidence of your
intransigence
with my case despite my attempts at settlement and the settling by your
company of all other similar claims to date.

Rang a couple of times, 1st: no record on their system, ring back in a few weeks, 2nd: I rang back in a week, verbal offer of full amount. (Then I sent the email) 3rd: rang again following week quoted 2 weeks, 3 days later (yesterday) got the letter offering full amount in full & final settlement of this claim blah blah blah. Posted back, signed, dated & sent recorded delivery same day, I'm not celebrating yet until it's in my account.
Fingers crossed for you, you WILL get there in the end :j

I handed in my 2nd letter on the 15th April claiming my £453 back and gave them the normal warning of replying within 14days, i handed it in over the counter at the local branch(Natwest) as i did with the 1 requesting my statements, but not heard a thing yet and i was wondering what to do next as it's been 18 days?

Unfortunately I can't take the credit for that email, another member of this site very kindly sent it to me& I adapted it to suit my own circumstances

I filed my claim on MCOL last week and online it says issued 30/04/07 does that mean that is the date it was served??
Some advice would be appreciated.

Hi Anna - you'll receive a 'Notice of Issue' from Northampton County Court through the post, and that will tell you the date the claim is deemed served - its normally 5 days after the issue date. It also gives you the date by which the defendant (bank) has to reply.

Morning All!
Just realised after reading a couple of threads that i may have dropped abit of a clanger!
After sending 2 letters to the borehamwood address and the customer care team in manchester i havent received a response. I rang customer care 2 days ago and they said they have received my letter but can take up to 8 weeks to get a response. Anyway i posted my letter threatening court action yesterday recorded but i sent this to my branch address! Was that the right thing to do?
After panicking slightly i have just emailed the same letter to the customer relations email address too just to be on the safe side. So now do i have to wait 14 days to apply at MCOL?
I really dont want it to get to that stage as i havent got the money to pay for it.
I hope i get a quick response like some of you seemed to have. Do you think i should just keep mithering them by phone? Aww thanks for the re-assurance, im just a bit worried could do with this money sooner rather than later i suppose like everyone else - I really do hope i dont have to file a claim but i suppose if im giving them deadlines i'll have to stick to them even if i have to borrow the money to do my MCOL! Just a waiting game now hopefully my offer will come soon just had two more bills in and nothing to pay them with!
I booked a holiday ages ago a week in spain which has all been paid for but i now have no spends! Get paid whilst im away but 4 days after i go - think im gonna have to pack pot noodles n soup to live on in the sun!
Just been reading about claiming back charges for credit cards and i have been charged quite a bit by mbna thinking back although recently i only get charged £12 - can you still claim for the £12 aswell as the higher charges?

All NATWEST letters i have sent have been faxed to the following number : 02082368010 this seems to be the best and most helpful number i have been given , good luck all hope it helps0
