A few peopleonhere have mentioned 8 weeks and 56 days as if this is a 'norm ' Is this the case and where does it come form. I have j ust plowed on with the process as per Martin's templates and I know they have approx 28 days to file their defense. I am helpoing my daughter with Barclays whohave written that it will take 8 weeks to investigate I have suggested that she writes asking for a response in14 days and then start MCOL claim justincae they delay at the 8 weeks stage but aI correct Should she wait the 8 weeks Help please0 -

Hiya, you have to remember that YOU set the timescales NOT the bank, the ball is in your court, some people want to wait to see what the banks do after being told "verbally" on the phone from customer relations a certain timescale (8 weeks or 56 days ect). If your daughter can (financially) or wants to carry on with HER timescales then she should take your advice with the 14 day letter & then MCOL, don't wait for the bank & don't let them dictate any longer. To be totally honest with you, I did exactly what you have done, then, I learned a lot on here & that Advantage Gold thing was one of them.....but.....a BIG BUT...... I left my claim running, I said "whats done is done", if it gets to the court stages then I'll change it. I haven't got that far yet but I had a verbal offer yesterday for the full amount claimed & was told I'd have it in writing within 2 weeks
so I wouldn't worry too much.

I think so yes, but I may have calculated it wrong, I had an A/V Gold account a few years ago. I'm sure natwest know the EXACT total of charges they slapped on our accounts & I suspect I undercalculated mine! maybe thats why they verbally offered the amount I'm claiming!?!?As I've said before I'm not holding my breath

Just wondering what i should do next someone posted and said to ring natwest as i orginally sent my 1st letter on the 20th March followed by a 2nd letter on the 12th April it has now been over 14 days and ive still not had a reply. I sent 4 letters in total copies to borehamwood and the customer care team in manchester just to be on the safe side but have had no joy.
If i ring them to find out where my claim is up to what number do i have to ring is it 0800 015 4212 as previously posted?
If they have no information for me do i then proceed to send the letter stating i am making a claim or do i just put my claim through MCOL?
Any help will be great.

Nat West didn't reply to any of my letters - I just carried on regardless, the first reaction I had from them was when MCOL said they'd acknowledged the claim.
From what I've read on the forum, even if the people on the phone lines promise payment, it's not necessarily going to happen - they'll say anything to delay the process. Personally I'd send the court threat letter, then start MCOL 7 days later - make sure all letters are sent recorded delivery, in case it does end up in your local court - I think I'll be there soon.
I read a post recently from someone who went to local court (the bank didn't send anyone to defend their case) and the judge agreed to a £2.50 charge per unpaid item being fair. I'm going for the whole amount being refunded, because when I go over my limit, the bank don't even send me an automated letter, so I don't think they should get any admin charge at all - that's going to be mt defence in court.

Thanks for that just tried to ring the customer care team and was holding for ages. Think i'll post the court threat letter today recorded and wait and see if i get a response from them and after 7 days i'll submit my claim via MCOL although i could do without doing that as i dont really have the money to spend! Hopefully they will get their !!!! in gear and reply to me with an offer beforehand!

Hiya,
Was just wondering if someone could confirm something for me.
I filed with MCOL on Friday and I believe that Natwest have 14 days from when it is served to acknowledge the claim but how do I know the date it is served?? Im just curious cause I want to be on the ball to request a judgement if they dont acknowledge.

The date it is served will be 5 days from the date you filed it - when they send you the paperwork, the date will be on it, or you can view it on their website.0
