Hi there,
....................... i just don't understand why they acknowledge and settle some before MCOL stage and not others also I have sent MCOL to the address I have been coresponding with as I was told this was the correct place to send to via Natwest do you think it matters?
many thanks to anyone who may be able to help
The reason Natwest is so inconsistent in its approach is that it is in a complete !!!!!!'s muddle over this, overwhelmed by the number of claims, and totally incapable of getting any sort of an act together. In the past three months they have settled one of my claims, made an inappropriate offer on the other, so its Court next week and when they dont turn up I shall get judgement entered and if they dont pay I shall send the bailiff in.
They have consistently screwed up our accounts for the past several years, mixing up business accounts with private accounts, charged interest after a loan has been repaid, paid direct debits after they have been cancelled, failed to answer correspondence. They can't even get their hol's in the wall to work propoerly.
In addition to our main claim, in the past month we have separately recovered another direct debit and forced them to repay an overdraft fee charged for an overdraft we did not ask for , did not need and did not want.
What a completer load of bankers!
They are totally and utterly useless and the only thing to do is sue them, get your money back and then fire them.0 -

Hi there,
I have just actioned a MCOL and am now terrified I am claiming £801 from Natwest and have so far had no reply to my previous 2 letters although I sent them registered post and Natwest Customer relations team have said they have got them, I just think maybe I will be the one who breaks the precedent and ends up even deeper in debt, i just don't understand why they acknowledge and settle some before MCOL stage and not others also I have sent MCOL to the address I have been coresponding with as I was told this was the correct place to send to via Natwest do you think it matters?

Frugalpam's quotes before you should help reassure you, she's in the same position as you are, don't worry, you will get your money back :j0 -

Hiya - as Paw169 mentioned, I'm in the same position as yourself. Don't be terrified, there's truly no need to be. Not too long ago, a business man got around £36,000 back from Natwest, and thousands upon thousands of people making smaller claims have got all their money back. Read my post (a few posts back from this one) to see where I'm up to.
Natwest like all the other banks are up to their necks in claims, and haven't got any system in place to deal with them, which is why some people get quick settlements, and others like you and me and countless others have to go all the way to the Court house. You WILL get your money back - just follow the steps laid out as you have been doing, and it'll come right, you'll see.

As some of you know, Natwest never replied to my claim letters and so I issued a claim through MCOL and it was served on Natwest a week ago.
I got an offer letter today offering me a 'goodwill gesure' - the amount of the fees they took off me unlawfully.
As its now in the Court system, I'm going after them for the interest and my Court fees. This is what I've written to them - hope I've got it right, and also hope it helps someone else!
Pam
Thank you for your letter which I received on Saturday 28th April, offering me a goodwill payment of £xxx which equals the amount of money you deducted from my account over a period of a few years in charges..................
Wow this sounds great, nice one.
Perhaps this could be used as a template and added to the main thread as a response to this scenario because im sure your not the first or last that will be in it.

Far from an expert but I would advise that you will get comfort and confidence from reading these messages/posts .I know that I do. Similar to yourself it took a lot of guts for me to start the process and am feeling vulnerable. I also think that I will be the first to be the 'test' case and lose. Obvious deep down insecurities. I received my statements quite prompt from Nat west and then Zilch -silence. They have not responded to any letter and I also fail to understand why they respond to some, settle and ignore others. I am just plodding on through the process and have filed with MCOL who have now served so now I have to wait and see if they defend Other s are near the point of sending in Bailiffs as Nat west have not responded
When I first started reading these posts it seemed that Barclays wer e the worst for ignoring people but Nat West is catching up.0 -
hi
I was very worried that I would be the one to end up loosing in court, or that I had not worked things out right. I think we all have our moments when we feel like we cannot fight the huge weight of the banks.
However I looked to this site for guidance, advice and moral support, which I got in abundance.
I have had very little contact from Nat West and what I have had, has been very intimidatory and I would say bullying.
Despite that I have continued with my claim, I just ( yesterday) received a cheque for almost 4 grand ( charges, interest and court costs) It can be done and if I can do it any of you can.
I know you will worry, but please believe me when I say if you perservere you will get your money back. Because that's what it is your money.
Good luck ( not that you need it)

Someone comes on here feeling terrified, scared, vunerable or worried in anyway for whatever reason because of THEIR BANK & the CHARGES and look at the response they get........I think it's absolutely fantastic the way you ALL are on this site giving encouragement & reassurance & words of advice to help ease the journey of claiming bank charges, keep up the good work....BRILLIANT :T0

Hi,
Does anyone know about how the court gets allocated when you file your claim through MCOL? Do certain regions all go through one court or is it just the closest court to you?
I was just curious cause I was just reading back through my claim after I had submitted and it is being processed through Northampton Court and although its only an hour away, im sure there must be a closer one to me.
Thanks
Anna0
