Does anyone know about how the court gets allocated when you file your claim through MCOL? Do certain regions all go through one court or is it just the closest court to you?
I was just curious cause I was just reading back through my claim after I had submitted and it is being processed through Northampton Court and although its only an hour away, im sure there must be a closer one to me.

Hi Anna - all the MCOL claims go through Northampton. Its only when the banks put in a defence that it gets referred to your local County Court, and MCOL arrange that referral for you.

I am trying to help my son reclaim bank charges from NatWest.
Over the last three years my son has had to pay unauthorised overdraft charges every month of £28. This has often been charged even when it has been the previous months charge that has made the account exceed the agreed limit. He only works part-time and is low payed so he is having great problems trying to keep the account in credit each month so the charges don't apply.
Is it advisable to try to claim back these charges (about £900) when they are still applying them each month, or is he best advised to get the account in order first?
Do NatWest close customers accounts that make claims for repayment?
Any advice about NatWest policy on this issue and what would be the best way to proceed greatly appricted.
Hi, I work for Natwest and at the moment I know that they are not closing accounts if people claim charges back, wouldnt surprise me if they started in the future though, good luck in your claimLola :A0 -

The letter I got stated that if I tried reclaiming charges in the future, they might offer me reduced banking facilities. Very petulant response, seeing as they've been ripping people off for years instead of charging a more realistic sum - its been a real moneyspinner for them (no wonder the banks announce such huge profits). No wonder they daren't show up in court to explain themselves.
As for them maybe closing people's accounts in the future..... I don't see what right they have to do that, if they shouldn't have been charging people such exorbitant amounts to start with. No wonder the FSA and OFT are investigating them
Maybe in future I'll put my money under the mattress and pay cash, and not let the bank get their hands on it :rotfl:

They dont have a right, but I am sure under the terms and conditions of customers account they will have a clause somewhere to allow the closure, either way (though I dont agree with them closing accounts by law they have to give you 30 days notice) Its' the biggest reason I want to leave the bank, I dont agree with charges!Lola :A0 -

natwest seem to be threatening people with a downgraded bank account should they reclaim bank charges back again...
i dont think they will give people a basic bamk account with no direct debit, cheque book or overdraft facillity cos then they would be nothing to bounce or get returned therefore they wouldnt be able to charge us anymore ridiculous charges..and they dont want that do they!!!

I am a bit worrried about having to go through the court process..natwest still have 4 weeks to go before the 56 days are up..does anybody think that before contacting mcol it would be an idea to report them to FO to see if get any joy of them before starting mcol?? in other words are they more scared of FO than going to court????

A lot of people have successfully claimed money back through the FO so hopefully they'll respond and tell you about their experiences. And of course it saves you the hassle of MCOL and maybe Natwest defending the claim - the FO deal with everything - and yes, I think the banks are pretty nervous of the FO. For instance, where banks have closed people's accounts, the FO have fined the banks around £250 :rotfl:

Success at last!!
After calling them constantly over the past 6 weeks wednesday was the end of the road for me lol
THey had 2 weeks until their 8 weeks was up so i decided to call and see if any offer had been made. Was 'greeted' by some arrogant woman who was obvouisly reading off a laminate! She told me no offer had been made so i asked realistically would an offer be made in the next 2 weeks? She said she 'didnt know'. I told her i was contacting the financial ombudsman as i was sick of being fobbed off. Called the ombudsman and they sent out the paperwork which was with me by the next day! Filled it in and sent it back friday. Decided to call natwest on friday and low and behold an offer! I was claiming £998 and they offered me £1008.
Was told it would take 2 weeks for the offer to get to me but saturday morning it arrived in the post! Sent it back saturday afternoon by recorded delivery! They told me 10 days, so fingers crossed!0 -
