NatWest (merged)

Well, I week after I served a claim on Natwest, I got an offer letter (undated!) through this morning! All the blah blah blah about the charges not being unfair etc, but that they're offering me a refund of the charges 'as a gesture of goodwill' (standard letter)
Now going to read through the thread to see how I reply to this - they didn't send this offer within the timescale I set out so I am of course going to pursue my interest charges and court fees, which adds up to a further £450ish pounds. Has anyone else written this sort of letter - any tips?
cheers,
Pam
I've just found this, might be of some help to you
Thanks to BEATE for this quote:
If you have started MCOL then you ARE entitled to the interest and court fees so write them something back along the lines of
I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.0 -

Thanks for that buddy! Just what I was looking for!:T
Yes - we should definitely have a celebratory lunch when (note, not 'if') the bank pays us our money - in full !!

There's so much information on this site, I forget where I've read most things & takes me ages to find it again, sometimes I come across really useful info by accident only to look for it again & I can't see it anywhere
I'll have to PM you with my email address for that lunch WHEN we win:beer:

Having read some more success stories today regarding Natwest I'm feeling a bit more hopeful that I'll get an offer before having to start my court proceedings which I can't really afford. I sent my 2nd letter yesterday so if I don't hear anything after 14 days I'll give them a ring.
Congratulations to all those who've finally got their money back.Paid off so far Natwest overdraft £1900 Kays catalogue £200 Personal Loan £2500 Tax Credit £1300 J D Williams
Still to go Barclaycard £880 Sainsburys CC £38.80 Littlewoods CC £208 Vanquis CC £390 Littlewoods Cat £821.38 Next £75.260 -
hi
are natwest likely to make a 2nd offer?0 -
Filed my claim on MCOL yesterday - it feels great :j to finally be in control after the letters, emails and numerous calls to Customer Relations where I estimate I have been on hold for well over 3 hours in total!!!
So now its a 14 day waiting game i asssume to see if they acknowledge.
Thanks to FrugalPam :T for all her help with the claim and of course all the other posts on here.

Hiya Anna - thanks for the thanks!
Oh isn't it great to be the one calling the shots by doing the court claim - I really enjoyed that bit :rotfl:
Keep us posted and ask any questions - we're all in this together!

As some of you know, Natwest never replied to my claim letters and so I issued a claim through MCOL and it was served on Natwest a week ago.
I got an offer letter today offering me a 'goodwill gesure' - the amount of the fees they took off me unlawfully.
As its now in the Court system, I'm going after them for the interest and my Court fees. This is what I've written to them - hope I've got it right, and also hope it helps someone else!
Pam
Thank you for your letter which I received on Saturday 28th April, offering me a goodwill payment of £xxx which equals the amount of money you deducted from my account over a period of a few years in charges.
I cannot, however, accept the sum of £xxx as full and final settlement of my claim. I will accept this sum as part payment only, and without prejudice, but will continue my claim for the balance.
<O:p
I have made a reasonable effort to settle this claim before issuing a County Court claim, but was disappointed that you did not acknowledge my correspondence (letters sent to you on 13th and 30th March, both of which were signed for), nor make me an appropriate offer.
<O:p
As I have had to issue a County Court claim because of your failure to deal with my claim (my letter of 30th March clearly stated that I would commence Court proceedings in 14 days if I received no response from you), I will now settle only for the full amount of charges + plus statutory interest + £120 court fees, a total of £xxx
<O:p
My claim was served on you by Northampton County Court on 22nd April, and you therefore have until 6th May to respond. I hope to hear from you in the meantime with a revised offer which is the total amount I am claiming through the Court.

<O:p</O:p
I look forward to receiving your response in the near future

Yours faithfully

Hi there,
I have just actioned a MCOL and am now terrified I am claiming £801 from Natwest and have so far had no reply to my previous 2 letters although I sent them registered post and Natwest Customer relations team have said they have got them, I just think maybe I will be the one who breaks the precedent and ends up even deeper in debt, i just don't understand why they acknowledge and settle some before MCOL stage and not others also I have sent MCOL to the address I have been coresponding with as I was told this was the correct place to send to via Natwest do you think it matters?
many thanks to anyone who may be able to help0
