    hiya everyone..
    just sent my LBA via recorded delivery.. i get a real buzz of posting them..
    however i received a letter from Stuart Higley this morning thanking me for my request of 6 years of statements and that they will be with me shortly????i received them 5 weeks ago!!! They dont know what the other hand is doing do they???
    Im so scared about having to go to court..tho i do intend to take it all the way if needs be...

    As far as I am aware they can only use the refunded money to pay off any unauthorised borrowing or missed loan / credit card payments...not outstanding loans which you are paying off normally.
    Natwest - LBA sent 26/04/07, FO. Sent email to Michael Duncan on 11/05/07. SUCCESS - Offer letter received 19/05/07 for full amount.
    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08

    hi everyone, can anyone tell me if they have started mcol and been able to do the exemption form at the same time online or do i need to do all the paperwork through my local county court? any help would be appreciated thanks!

    :j hello everyone again, just to let you know progress, i called today again on0800 015 4212 opt 2 and got through to the collections dept, a nice lady told me that an offer letter had been sent and was put on the system on 12 april, i said i hadnt recieved no such offer in writing and that if i had i would have accepted it (claim was for £1871.49, offer £1799.49), she couldnt understand why i hadnt recieved it and asked me to call 0845 3030456, i said i called that number first as i was given it the other day but today it said welcome to bank of scotland you are in a que and will be answered shortly:rotfl: , she was as baffed as me, anyway she gave me freepost address and told me to send a letter saying i was willing to accept offer but need it in writing and credited to account and she would put the same on her system, so i have, :T and will post it recorded delivery in morning ive given them 7 days to reply, so we will see, dont want to get my hopes up too much but if it saves me going to court!!!

  • Hi after sending my first letter asking for my bank statments from NATWEST i recieved them in no time at all. However i then went onto sending my first template letter telling them i want to reclaim my bank charges, but i heard nothing but i was told this might happen, so i went onto my 2nd letter threatening to take them to court. The 14 day time period has now ran out and i still have not heard anythink. I sent the letters to my local natwest bank, would this make any differents? Or should i carry on with court proceedings? A big thanks to anyone that could help me out.

    The same happened to me with NAT WEST , I continued with MCOL and the Bank defended, but was one day too late , so Judgement was made in my favour.
    Nat West still have not responded or paid up so I have now instructed the Bailiffs to execute a warrant to recover my Money.

    I have read on this site that some people took the claim process to the Banks Head Office and others like me direct to the Branch in question, it does not make any difference , so my advice is to continue with your claim using MCOL.

    Has anyone else had to send the bailifts in with Natwest, we really did'nt want to take it this far, we won and we gave Natwest plenty of time to pay us, then we phoned them and they told us they would not speak to us and so we took it to the next stage, its tomorrow that the bailifts will go to our local branch and get the money(wish i could watch!!), we phoned MCOL yesterday and they said this was rare and we r the first in our area.. and i have looked on the boards but can't find much info on this ...
