    has anyone had their refund deducted from loans outstanding? i have a loan which i have NOT defaulted on, but dont want them to take the refund off of it. can anyone help

    i have the same problem i have been offered a full refund and have fought and argued with the bank over their rules of offset but i have been told by every one i have spoken to at the bank that in the event of a refund of charges being given the bank can pay the money into any account you have with them and it doesnt have to be the one the charges were taken from.
    so as i never recd the offer in writing i proceeded to the small claims court within the given timescale and now i am hoping that when i win i will be able to stipulate a payment method (CHEQUE ONLY )as acceptable.
    if this turns out to be the case i am keeping my fingers crossed that once the order is stamped and signed by the court then that will be how they have to pay me.
    dont know if it will work but its worth a shot i think.
    otherwise there will be nothing i can do.
    hope it all turns out out ok for you and il let u know if my plan works

    I wrote back in march to get my charges reclaimed and was told promptly on the 2nd of april they recieved my letter and can confim my claim is in progress and an offer will be with you within 21 working days. i thought fine, i will be leniant for this.

    i doubled checked a week later to see if there was any more progress. the lady on the phone said the same thing. I thought i will be leniant they probably have alot of requests i will wait 21 days.

    Now i still have not heard anything and i have phoned again to see if they are any nearer to senidng my letter and now been aprubtly told that it will take 7 weeks for my confimred offer ltter to be issued, she quickly then went on to say you will hear something by the 16th of may!! i said i have been told different twice now by two differenmt people (gave her there names etc) that it would be only 21 days. she rambled on about this being total legit and within there fsa agreement!

    What do i do now? shall i respect there desecion and hold out for my 'confirmed' (but not given a figure for?) letter offer or do i just give them the 14 days till i go to court letter?

    I am coming to the end of my tether with natwest now...i am worreid though that if i send the letter this so called 'confirmed i will recieve an offer' will not go through and they will stick up there defences and dig there heels in?

    i dont know what to do and it is stressing me out now! i have been nice and now im losing my patients...what next?

  • I was reading this fine thread, and came across a post -
    now they sent off a request for a refund after I sent mine, and but they have had their larger amount refunded before me!

    Don't they do it by date order?

    Not sure if this will help you at all but I wrote to Natwest 26th Feb, followed up on 12th March. Heard nothing not even an acknowledgement letter! Called Customer Relations 30th March was told offer made and letter should be sent withing 7 days. Again heard nothing so called again after the 7 days to be told upto 21 days.

    Emailed and called again and was told 20th April. Letter arrived 21st, 2 days shy of the 8 week deadline.

    I wrote to Natwest in early March, and again at the end of March, and neither letter was acknowledged. The last time I spoke to them on 30 March, they said it could be up to 56 days before I got an offer letter. I wasn't prepared to wait until possibly the end of May - a total of nearly 3 months since I started my claim, so decided to go down the MCOL route.

    I don't think they've got any system in place to deal with claims in date received order - I think it's the luck of the draw whose letter gets pulled out of the mailbag, and yet another lottery to decide whether they'll pay up after letter one or two, or take it to the court claim stage. What a shambles !!

    I fully agree with this.It is the luck of the draw The first request for statments was responded to quite promptly but every other letter has been ignored.The onlytime that I rung I was told to 'write as they did not have a phone number'Ihave just continued with process and claimhas nowbeen served by MCOL

    I am not good at checking other 'threads' but I am in the same postiion and concerned.
    At one point should I ask for a cheque ? or stipulate that I do not want it offset on my loan.
    I have set up another account and fully expect and have no problem with paying off my overdraft.But I do not want them offsetting on my loan Any advice please?

    I need some more advice before I send my second letter. Natwest have now applied quite a few more charges to my account and I would now like to add these to the original charges I listed in the document I originally sent them.

    Would I have to go back to stage 1 and send them another letter stating that I'm revising the amount of charges that I sent in the original letter?

    Hiya - I'd write the 2nd letter as planned, and include an updated list of the charges, pointing out that, since your first letter, additional charges have been applied to your account, hence enclosing the updated list of charges.
