    They quoted this 56 day affair to me also - several people have had this quoted to them.
    I'd written twice, and neither letter was acknowledged within the 14 day timescales I'd set. By the time I rang ( 4 weeks had gone by at this stage since they got my 1st letter) they told me it would be up to a further 56 days before they sent me an offer, not 56 days (8 weeks) from when they received my 1st letter. In my case, I filed a claim under MCOL, as I felt I'd already waited a month, and wasn't prepared to wait a further 8 weeks in the hopes an offer letter materialised.

  • Thank you, I am claiming back £1700 on 1 account & £1245 on another both with Natwest, Do you think I should phone them today & say I am proceeding with court, as orignally I was claiming with Interest, but when I called them last week they said we dont refund the interest, I am so confused, dont no what to do now!!

    Thanks for this Pam, also I have had a little bit of trouble with the particulars section. I used your previous posted links to threads and copied and pasted the statements but it was a bit too long so had to shorten it a bit and cut bits down and am now worried that I may have missed something vital, If I copy and paste it would you mind having a read for me??:o

  • I don't see why that would be a problem.
    A friend of mine phoned up RBS, they told him a letter should be with him next week, so he's holding off on the moneyclaim proceedings until that deadline.
    But it shouldn't be a problem doing that. They can only say no (we won't be paying out) or yes(we will be paying out).

    It's all meant to delay you, put you off.
    I'd anticipate that they'll pay you, as I think they don't like the bigger claims going to moneyclaim, due to the larger court fees and vast amounts of interest that can be added on

    Hi does anyone who's sucessfully claimed back from Natwest know roughly how long they take to make the direct transfer to your account?
    Decided to accept their offer and returned the form back last friday just hoping it wont take another few weeks wait!!

    Your a star, I really appreciate your advice, it just feels like the banks can do what they want with us, Its about time we are all standing up to them, it seems like what i'm experiencing is the same as everybody else, well they have untill tomorrow then I guess its time for court, be interesting to see what happens will let you know.yes luckily enough I do have another account open.

    I called natwest this morning to see if any progress had been made as ive not even had a offer yet! Thier 8 weeks is up in 2 weeks. I was told it would not be dealt with in this time and i would have to contact the financial ombudsman. Not heard that one before! I dont know weather to send the court papers i have here off or to wait another 2 weeks and contact the FO..

    I dont know what the FO is or anything about it to be honest!

    What route would be quicker?

    doyou know I have been reading through these claims and what people have done, I joined this 2 weeks ago and I read one today saying I wonder how many people give up at the first hurdle, well I phoned and asked for my statments that was 2 weeks ago and I have been sat here thinking just give in and carry on struggling and forget it they can't even send you the statments out, and then I read on, why is it they can take your money at the flick of a switch but us we have to beg and ask for our staments and go through the threats of taking them to court, they know they are going to give you your money back, so why don't they just look at the charges which they know what they have charged you and just put them back in your account, so I have sat here wondering what to do so have got mad and written and asked for them and just dropped them off at the bank now my letter and its made me mad that I have had to go and do this use my time and petrol up cos they could not do what I asked over the phone, so now I have had my moan and gripe I am going to carry on even tho its a waiting game, thankyou.

    I phoned at the weekend to ask if there was an update on my claim. I was told that a letter had been posted out and that it was showing that they were going to offer £293 (of a £1540 claim) I told them they would be hearing from me again shortly. Anyway the letter arrived today, saying they were looking into my claim and would get back to me shortly. That was it, no mention of an offer. So I am afraid Natwest will be receiving my 2nd letter on 26th and if I here nothing of a satisfactory nature within 7 days then they will be served with the necessary court proceedings.

    I was thinking of maybe sending them the same letter every day for the next 2 weeks each with a day less on the 14 day response time. Just to incur them even more costs of opening the letters etc....I can afford a few stamps...lol

    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08

    Try not to get too stressed about it. At the end of the day you will get your money back, they may try and do everything they can (apart from defend it in court) to put you off but they know they haven't got a leg to stand on. If they did then their multi million pound law firm would have advised them that they would win in court and they wouldnt pay anyone back.

    They are running scared and its about time. Most people in this country just sit back and moan about lots of things but tend to do nothing about them. Its quite refreshing to be part of something that is actually taking these bas**ds on and winning.

    Go into the branch and ask them to print out your statements there and then. Even take a cheque or £10 in cash in case they mention the Data protection fee. They can print out all of them in the branch. I asked my branch why they could send out a letter saying i had bounced a cheque within days of it bouncing but they couldn't send out an offer letter or statements within 40 days or even 56 days? They had no answer for that apart from they are receiving a large amount of enquiries, to which I pointed out if they hadn't acted unlawfully in the first place they wouldn't be getting all these claims. I also asked them why they were paying out thousands if not millions to people if they still claim they have done nothing wrong....again no answer. About as usefull as a chocolate fireguard.
