  • hi, im trying to claim back £9500 in charges which does include interest over the last 6 years, ive gone through the steps from this very helpfull website, they havent responded to the 14 days to reply letter so i phoned them, they said they havent recieved such a letter, so, do i either send the next letter which gives them 7 days to respond or do i send out the 14 days to reply again but recorded delivery? i did send the 14 days to reply letter to my local branch but when i phoned them they referred me to the customer relations department is this where i should of sent it to in the first place?

    i hope someone can advise me on what to do,

    i sent all my letters to my local branch recorded delivery and i think then they just pass them on to the right dept. i would send next letter recorded delivery. all my letters have been aknowledged, hope this helps
  • anyone know the address i need to put in the mcol for natwest? being a bit thick i know !!

    Good luck with your claim! Natwest haven't acknowledged or defended mine yet (early days tho').... but did find time to send me a letter trying to flog me life insurance :rotfl:

    Don't let it worry you. If you go through the normal letter process ignoring what they say about their timescales, then IF it gets to the stage where you put a small claim in via MCOL, and if and when you win, they will pay you by cheque anyway and that way you can choose how much, if any of your overdraft you wish to pay off.
    I would say don't bother talking to them as most of the advisors have scripts, its not their fault, i was one of them once! Just carry on with the letters and when each one runs its course, send the next and so on. They all say its about an 8 week turnaround, but they soon respond when you take them to court and thats nothing scary either.
    The thing about te account being overdrawn, is it your everyday bank? If it is, it may be worth opening a parachute acct and moving everything over to the new one, and then they can't stipulate any amount to pay the overdraft back.

    I'm pretty sure you'd be ok to send your LBA letter now *(recorded delivery, of course) - I think Edinburghlass would say this, but if you feel you want to, you could re-send that letter they reckon they can't find. I suppose if you've got proof they've signed for each letter in the reclaiming process, they've nothing to pick holes in.

    I have been successful at getting a refund from Natwest Credit card, and now i'm claiming back a small amount of charges from my old bank account with Natwest, I have been told today by my local branch today, that they have mislaid my letter that i hand delivered and had stamped to prove it. The 14 days is up tomorrow and they've mislaid it!!!:mad:
    The man who claimed to be the branch manager but sounded about 12, advised i could either send in a copy or he could take from me the amount i am trying to claim and give the information to his colleagues in the dept that deal with charges but it would take them 8 weeks to respond. I have advised him that by that time, it will be in court as i plan to send the court letter th day afer tomorrow. He didnt seem bothered in the slightest so sod them. They'll be getting my next letter in due course.

    I have had every letter, except the first requesting statements,ignored by Nat West. I delivered mine by hand into the branch I cannot accept that they have been 'lost' or not recvieved .I have just continued going through the advised process I sent one additional letter giving them a further chance to reply with an offer. I said that I would accept the charge fees of approx £ 7000 rather than the with interest charge of approx £ 9000 if they responded within 7days . Still no response and I have now issued my claim.
    Far from an 'expert' and am finding my feet as everyone else but I would advise one further letter and then file with court . As long as you keep copies of all for your 'evidence' It appears to me that in any event a) they will use every delaying tactic out until forced by the Court to give a response and b) they are now probably so inundated with cliams that they are behind.Therefore by giving them more time you are only playing into their hands Good article in the Mail Financial supplement this Sunday re this Bank staff working to a script /delaying tactics so people get fed up and only the most vocal or those going to court are winning their money as they are hoping people give up
    <ind you I will prob be the one that has to go 'all the way'
  • Just to let everyone know of my situation.

    Sent first letter 26th Feb.
    Sent LBA 7 days letter.
    I then made a claim (MCOL) against natwest on the 3rd of April and today I received an offer letter to pay back £1799

    My advice is, dont bother with phone calls and stay to you time limits.

    Not once I put a call into them and just got on with the job as advised by Martin.
