Hi please can anybody help as I'm pulling my hair out, Im in the process of a claim, Ive sent the letter asking for the money - not heard anything sent the next letter to say threating court they have untill this wednesday. Called Natwest today spoke to some unhelpfull jobs worth woman!! said it will 7-8 weeks from the 21st March when I first sent the letter, then another 10 days to get the form, then another 2 weeks to raise refund, they are now telling me they are going to keep the money as I'm overdrawn to pay them off even comtemplated using a company to claim for me its driving me insane. Last week I was told I should have heard last week because its such a small amount it wont take long. Help!!! do they usually keep the money. The account isn't closed as its overdrawn Ive asked for a cheque but they say no Please help :rolleyes: :mad: Any help would be very much appreciated.0

Hi, Apologies for a pretty basic question but can anyone tell me where I send my first letter, is it to my local branch or Nat West Customer Relations?
I sent mine to my local branch FAO Branch Manager, but when I asked in the branch about it they said all mail goes to the regional office for sorting etc.

Personally I would stick with the claim and continue to get all your money back.
If they then decide to close the account you can investigate it with the Ombudsman.
I would recommend setting up another account with a different bank (Alliance and Leicester are doing a great Current Account Direct Plus with good interest rates etc...) just in case Natwest do get a strop on and close your account.Natwest - LBA sent 26/04/07, FO. As far as I am aware this is how it stands :
If you have a loan/overdraft with the bank and you are within your agreed limit and have kept up to date with any loan payments then they cannot make you use the refunded money to pay off the entire overdraft or loan. They can however make you use the money to clear any unauthorised borrowing or missed loan payments.
I wouldn't say that was the gospel but thats what I can deduce from various postings and websites. Contact the financial ombudsman and enquire if still unsure.

can anyone tell me how long I should give natwest before I ring them about my statments, I am going in to my third week I rang and requested them and she was nice and told me the charges and asked if that was all and then said she would get them out but not herd anything,

It may have been better to write and request the charges. Then you have something to use against them if they fail to supply you with the info you requested within the 40 day period set in the Data Protection Act. If they don't you can then report them to the Information Commisoner for failure to comply with the terms of the DPA.
Banks tend to mysteriously lose all records of phone conversations when your relying on it but then seem to find everything if they are relying on it.

Maybe Natwest are peeved I'm claiming back charges plus interest plus court fees - they sent me a letter this morning trying to flog me life insurance cover !! :rotfl: :rotfl:

Hi can somebody please tell me what I should do now. I have sent the court letter to my bank Nat west and I waited 14 working days but had no reply so I sent the final warning letter and 7 working days is up today but I have still had no response, should I phone the bank? I hand delivered the letters so they can not say they have not received them. I am claiming back £423.00 in charges I did not ask for the interest on these charges. Since you have threatened twice to take them to court then it is your logical course of action to file at MCOL online or at your local court. I get the impression you were hoping they would settle beforehand but since your time limits have been breached twice it doesnt look like they are going to. You could always wait the 8 weeks they are allowed to deal with your complaint by the FSA as an alternative and if they dont come up with a satisfactory offer then take your complaint further to the Financial Ombudsman instead of court.
If you ring the bank and they make an offer get them to put it in writing and consider the conditions of acceptance before agreeing and ask for a firm date of payment. Whatever you decide to do..good luck0 -

Well, they've gotta try and raise cash somehow or other, after having had to refund thousands upon thousands of pounds in charges !!

hi everyone, just to let you know i called natwest today after sending threatening court action letter 14 april on 0800 015 4212 option 2 and was asked to call 0845 3030456 i was given a reference number and was told i would be recieving an offer between now and 30 may, she said i was entitled to £1799.49 when i had asked for £1871.49, dont know if i had got a couple of charges wrong or something and i didnt ask as she is the first to actually mention a figure everone else i had spoken to had said they dont know and it will take 56 days blah blah blah, now i dont know whether or not to wait until then or start court next week and as far as i can see the courts seem to be taking ages aswell!!! ive also got an overdraft that im paying back monthly and have just unfroze my account as i had disputes with ex being it a joint account, has any one else been told anything similar and been given reference number or do you think this is another fob off???:rolleyes:0

Last time I called, I was told an offer letter for full refund of charges would be sent out, but it could take up to 56 days. I know the court thing might be lengthy if the bank defends and it goes to my local County Court, but I didn't feel like waiting 56 days (8 weeks!!) only to find the alleged offer letter never arrived (like the one they supposedly sent acknowledging my claim) and THEN having to start MCOL.
I decided to file on MCOL and be the one steering the ship! Also, as mine's quite a large claim, I decided I also wanted to claim interest as well
